Oh they work in Cochise, Pinal, and Maracopa Counties. In leg shackles and broad stripped jail clothes reminiscent of the chain gangs of old except the stripes are a pinkish orange color and their job is clearing brush and removing trash from the highways.

it works only if the sentencing guidlines allow for diversion.
In addition, there will be an issue if the person was actually deported and simply did not leave.
last point, consideration of additional factors are NOT by a perponderance of the evidence.

States need to reinstitute work-farms. Put them to work earning their keep, rather than lying around all day long. I've said it before: put them to work building the U.S. a twin 40' tall security fence along our entire southern border like the one in Israel. Let the illegal alien criminal earn his keep.

I saw some chain gangs clearing brush in Arizona on the road from Florence to Tucson. We could use some of them here in California.

There's a clinic behind where I work and it is fun to look up and notice going between buildings that the Sheriff is escorting some prisioner to/from that clinic wearing stripes and in chains (ankles, wrist to waist and ankles).
