It's great to see that now even Washington State has passed into the column of those that the rats can no longer win without voter fraud. This has got to have thinking rats scared to death.

The problem, with a revote, is that it would disenfraudise all the dead voters, out of state voters, multiple votes, votes made up after the second count etc.....

There will be lingering anger if the court nullifies the governor's election AND the legislature fails to authorize a revote.

In such an event, I think alot of voters would see (D) by someone's name and vote against that name or not vote. The next election for state legislators is 2006?

During the interim, if the governor's election was declared null and void, and Gregoire refused to step down and the legislature refused to authorize a revote, then people would know she is illegitimate.

Illegitimacy will not fade in memories. Everywhere she would go she would be seen as illegitimate, She could not govern.

The legislature will I think authorize a revote because of this illegitimacy. Otherwise they would have difficulty representing their constituents who want a revote.

This is all based on a court decision to set aside this election for governor.

Of course democrats would like to think that as time passes people will forget. There's a problem with that thinking because there is a court case that will keep the issue in the public eye. The only way they get past this is if they win in court.

So the court calendar will keep the voters interested.

Otherwise I would agree with you that people would forget.

As has been pointed out, the WA recall laws don't allow a possibility of it at this time, but WA does have the initiative process. Changing the law to allow recall for broader purposes might just be what is called for here.

I remember having this same discussion several weeks ago with the poster Publius who is very knowledgeable about the exact laws in Washington State regarding recall and initiatives.

I recall him saying the recall was part of the state constitution and that an initiative cannot be used to change the state consitution. It would be to the legislature to change the consititution.

Thanks Gretchen, Our "Governor" was at a function this smoring that I attended. The other dems tried to prop her up as Gov, but we weren't buying it.

I'm not a legal expert, but I'm not convinced this case could be appealed beyond the WA Supremes, to the 9th Circus. It's a state matter, involving a state election and unless there are Federal due-process issues I think it would stay within the state and interpretation of the state constitution. The feds may not have standing to consider or rule on the matter.

Perhaps FReeper legal-beagles might comment here.

WEll, let's just say that I didn't do a lot of enthusiastic clapping ;)HOWEVER, we got here on our own - Now perhaps this election debacle will get the Republican Party & other Washingtonians back onto the right path and away from the DIM View of the world.

Maybe the good citizens of Washington could organize a tax protest and withhold their state income tax checks until justice is done.
