RADIO PERSONALITY RICK ROBERTS is proposing a recall campaign against US Senator Barbara Boxer, citing her obstruction of the certification of the Electoral College vote, and her disrespect of Secretary of State nominee Condoleeza Rice.

No, it is not. There's nothing in the Constitution that permits it. Prior to the 17th Amendment, the state legislature could recall a senator, because the senator was appointed by the states. But the 17th made that impossible.

Following is the entire 17th Amendment -- in my opinion, one of the most destructive amendments as regards the balance of power between the states and the federal government.

Article XVII.

The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof, for six years; and each Senator shall have one vote. The electors in each State shall have the qualifications requisite for electors of the most numerous branch of the State legislatures.

When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.

This amendment shall not be so construed as to affect the election or term of any Senator chosen before it becomes valid as part of the Constitution.

Wrong. Federal elective offices are governed by the United States Constitution, not by the state constitutions. There are no provisions in the U.S. Constitution for recall of federal elective officials.

I'm surprised too that Rick doesn't know she can't be recalled.

But it also shows that the DU'ers don't know that info either. If they did - they could have just ignored Rick.

I think they can only be removed by the same impeachment process that was used for Clinton ..?? Am I correct ..??

This simple statement caused the Left to: Petition Rick Robert's radio station to fire him. Call for a general boycott of all of Robert's advertisers. Deluge Rick Roberts' E-Mail with vitriolic emails. MOveon.org, and DU have both begun campaigns to take Roberts off the air.

So?

The Left, at least, defends their friends and ruthlessly attacks their enemies.

We should do the same.

To the States and the People, respectively. However, determining whether a Senator is or is not a Senator is an exercise for the United States Senate, and no other entity.

Herschensohn lost because the GOP refused to throw money into that race, not to mention a last-minute smear campaign launced by Boxer that nailed Herschensohn about his proclivity for nude bars. No GOP candidate has come close since and there are none on the horizon.

Certainly the Senate has the lawful power to determine Senatorship...but is it spelled out in the law that no one else has that power under any other circumstance?
