MIAMI (AP) _ A federal judge has set a Monday trial date for the claims of a dozen people who said they were wrongly assaulted by federal officers during the raid that removed Elian Gonzalez from his family's home.
The plaintiffs say they were innocent bystanders who were gassed and beaten outside the home during the early morning raid on April 22, 2000.
U.S. District Judge Michael Moore set the trial date Friday.
"I think the public's going to be surprised that elderly people were gassed while praying the rosary," said Tom Fitton, president of Judicial Watch, which represents 11 of the plaintiffs.
The federal government's attorney did not return a message seeking comment Friday.
Elian was one of three survivors of a November 1999 shipwreck that killed his mother and others fleeing Cuba. He was turned over to his Miami relatives while his custody situation was resolved.
The raid took place after government officials said the family refused to return the boy so he could be taken back to his father in Cuba.
I had not realized that this STILL had not taken place. The wheels of justice seem to be grinding exceedingly slow in this matter.
Hard to believe this was nearly FIVE years ago, and remember how much it inflamed us then, as just the latest
bull-in-the-china-shop posturing by Clinton and his ballerina-like AG, the Lumbering Behemoth, Janet the Reno.
I couldn't remember which Clinton goon got involved.

Puzzles me that many people who think that Elian didn't have 'enough' due process (he did) kick and scream about the due process of appeals in DP cases....

No immigration office is located "on the shore". Illegal.
Forget his Mom died trying to get him here, his "father" was not her husband either when she had Elian, or when she left Cuba?
An illegal alien's parentage or lack thereof is of no concern to the law or to me.
Must have been one hell of a threat to national security to require a SWAT team wannabes from INS to snatch a screaming seven year old from his American blood relatives.
The reasoning matters not other than a good example of what illegals should expect.
If you imagine klinton had any clue about the entire incident then I pity you.
He did not have the ability to control such things, nor was he interested.
You just favor illegal Elian because he was cute and he was a
good example of klinton's mismanagement of his staff.
Multiply him by ten thousand, jam them into your community and get back to me.
