I believe that the Supreme Court declared social security constitutional, after FDR packed the Court.

FDR packed the Court.

FDR never packed the Court.

I would find it difficult to believe that Social Security is unconstitutional. It has been around for 60 years. Certainly some court somewhere has found it constitutional.

Ever since Marbury v. Madison we've had Humpty Dumpty deciding the meaning of the Constitution. As he revealed to Alice in Through the Looking Glass:

'When I use a word,' Humpty Dumpty said, in a rather scornful tone,' it means just what I choose it to mean, neither more nor less.'

'The question is,' said Alice, 'whether you can make words mean so many different things.'

'The question is,' said Humpty Dumpty, 'which is to be master - that's all.'

FDR did not pack the court. He merely threatened to and the "conservative" Supreme Court caved.
