If the bankrupt internet company, Cigs4Cheap.com, was based in New York when it sold cigarettes to New Yorkers sales-tax free, it shouldn't be legal to charge the buyers.

I've read the seller is supposed to pay the sales and other taxes upfront before the sale and then collect the tax back from the buyer. That's what Amazon said too, when I e-mailed them with my question. The internet tax law, as it applies to them, is on their site.

Because if we did every lying, theiving member elected to the Congress would be required to resign.

This is also true of many thousands of "legally" elected local and state "officials" who also know who they are!

I may be mistaken but I thought buying anything through the internet, mail order, ebay, etc.. from out of state meant you didn't have to pay sales tax. Cigarettes i suppose didnt' fall under that but now Bloomberg is saying that ANYTHING bought out of state YOU are responsible for paying sales tax..I thought it was the sellers responsibilty to charge sales tax if necessary, not chase down each and every buyer of some product and nail them with a large bill and 30 days to pay up or else. Doesn't everyone buy stuff like bed linens or towels, clothing, etc... from the internet usually from out of state? Will we all get a letter going back a few years saying we owe like $40,000 for the purchases of everything we bought since the year 2001 or something like that? I'm wondering what's to come in the future.
Since the company Andy found that had his BRONCO cigs available happened to be out of state because they DON'T sell that brand here and he orders them. He sees a total, pays it via credit card and waits for the delivery not knowing if he was charged tax or not because the seller figures taxes in I thought. Plus like mentioned before, out of state purchases people thought were tax free anyway. He wasn't trying to avoid tax, he just wanted to find his favorite economy brand of BRONCO's. That's all, now he's being treated like a criminal along with thousands of other people. The FACT that they KNEW the exact number of cartons from 4/2002 through 7/2004 and that they were delivered and signed for is very scarey. That's why he went to the NY Post to ask about the letter. The letter didn't even explain how they got his name, what retailer he purchased from, or anything telling how they knew so much about him. That is what was the alarming thing, not so much the $1005 due. They must have gone to U.P.S. and got their records of signatures, it's the only way they could have known of delivery. Isn't that sort of infringing on civil rights? or privacy?

When someone fills up their gas tank in New Jersey, do they have to go ahead and pay New York or Ct. state tax on it? It is cheaper in New Jersey. Did you ever see all the NJ, Pa and Maryland vehicles at the malls in Delaware? Buying a TV set in Delaware and bringing it over the state line is criminal? When do we all get our letters?

There's a site called www.smokinglobby.com which has forums and discussions about the yessmoke.com seizure back in November (150,000 cartons at JFK).

Apparently some of those folks have gotten letters from US Customs, I don't recall that anyone had gotten a New York tax letter. But I haven't been there lately so you might check it out.

In the case of yessmoke.com (a Swiss company) it will be difficult for NYC to make a case for taxes. First, yessmoke.com can't release it's sales records under Swiss law, not even to US Customs let alone NYC. Period. All of the American companies are obligated to produce customer records by law (whatever that tobacco law is, can't recall the name).

While it is possible for New York (or I suppose anyone with a subpoena) to check credit card records, in the case of yessmoke.com they were also selling a huge inventory of luxury (e.g., French, Italian, German) foods and wines. So presumably a yessmoke.com customer could demand proof that they'd bought cigarettes rather than foods. There is no such proof.

There's a lot of mystery around these foreign cig seizures. It was always the obligation of U.S. Customs to inspect the package, assess duty and federal taxes, and ship the package to local Post Offices for collection of those taxes.

Well, talking to family and friends about living in New York City and the costs skyrocketing of rent and basically everything. The working/middle class people are slowly leaving, going to the suburbs and other states so NYC will soon be left with the very rich and the very poor.

This is the same logic Fletcher is using. Well, at some point, this tax hike will cut the revenue that it is supposed to raise. The law of dminishing returns. The higher the tax, the less revenue you get. There has to be a balance and these radical tax hikes, by Republicans like Draud and Fletcher, are not the solution.

Why produce a crop and make it harder to sell and criminalize once non-criminal behavior, while creating a booming black market?

If we follow this logic, how about taxing fat people $1.00 per pound and force them to lose wait. You know, weigh them in once a quarter, or month, or maybe a year and for every pound of their optimum weight tax them $1.00. For those under their optimum weight, let's give them a $1.00 per pound government hand-out, so they can gain weight? Both these ideas are absurd, the radical tobacco tax and the 'weight' tax. Remember: Senator Bunning from Kentucky suggesting to Billary during the National Healthcare debate (Hillary's congressional testimony) that we should tax beef, to force people to lower their cholesterol? That was great sarcasm from Senator Bunning, and shows the absurdity of all these do-gooders, like Draud and Fletcher, who are pushing for these ridiculouly high taxes on tobacco and alcohol.

I hate to see what this guy would do if terrorists set off a bio bomb "I am banning all fried foods!" I don’t understand the concept.  Smokers are using a product that if they didn’t use, the government would make NO money. The government raised the tax to a point where it was more attractive to buy elsewhere than pay the tax.  This is called free exchange of goods and services.  (Free enterprise).  There is no cheating here; this situation allows for no such thing as cheating.  If the price is too high, buy elsewhere.   

These people need to tell the state of New York to go to hell.  From what I understand, it is still illegal to tax internet sales unless the store has a physical location in your state.  When I make internet purchases of other goods there are no taxes unless there is a physical store in Kentucky.  

This is nothing but greed.

New yorkers get the living hell taxed out of them, the highest local taxes in the country etc etc. yet every election, who do they vote for overwhelmingly? Democrats over and over and over. Who do they vote for as Senator? The most corrupt liberal in this country. This is like asking a crook to rob you then saying "Waah, why did you rob me?" Pure lunacy
