The Ohio Supreme Court on Wednesday dismissed challenges brought by voters seeking to overturn President George W. Bush's victory in the state and the re-election of Chief Justice Thomas Moyer.
The 37 voters asked to drop both cases Tuesday. The high court granted the resquests without comment.
Attorney Cliff Arnebeck represented the voters who wanted the court to examine several Election Day problems such as long lines, shortages of voting machines in predominantly minority neighborhoods and problems with computer equipment.
The 2004 US Presidential election turned on the state of Ohio's 20 electoral college votes, and not until preliminary results were finally made available the morning after the vote did Democratic presidential candidate Sen. John Kerry concede.
Arnbeck said Tuesday that he could not expect to win given the US Congressional certification of the votes last week and the upcoming inaguration next week.
In declining last month a motion to remove himself from the case, Ohio State Supreme Court Chief Justice Thomas Moyer, a Republican called the voters evidence in the case 'woefully inadequate.'

Headline: Bush wins again!
I'm sure the Dummies are already chattering about how the courts have selected Bush yet again.
How pathetic.
will barbie boxer stop the crocodile tears now ?
I felt a tremendous disturbance in the Force, as though millions of DUmmies suddenly cried out in terror and were suddenly silenced.....
Maybe next election cycle the rats will fix the voting problems in their precincts. Nah, then they will just have less to whine about.
No, this is just part of the brilliant legal strategy of Cliff Arneback. No, I'm Series. I read that the brilliant Andy Stephenson (late of BBV.org) is now working with Cliff, and they just need some more funds to break open a HUGH new case.
Arnbeck also withdrew Moss V Moyer.
He does not say why. Nothing to do with Presidential certification.
Maybe because his primary piece of evidence was that people voted split tickets.
In the DUmmie mindset, it is impossible for someone to vote for a republican candidate and a democrat candidate on the same ballot.
Huh? So he was arguing that all split ticket ballots must be awarded to the Dem candidate.
DUmmie logic and legal prowess at its finest.
=8-]
Only for this election season. We are going to see a variation of this after each election from now on if a Republican wins. It's the new way to undermine our constitution and way of government.
Smackdown on Jesse Shakedown!!
Roger that! :)
"the brilliant Andy Stephenson (late of BBV.org) is now working with Cliff, and they just need some more funds to break open a HUGH new case."
And the money goes to Bev Harris's non-documentary, no doubt....
Dems knew overturning the results was fruitless - their goal is to create another "selected not elected" myth.
Sure, there's a need to reform the election process (sign me up!) but not selectively. If the DUmmies genuinely believed the election was riddled with fraud, they would be contesting the results in Washington state too.
Perhaps one day Dems will place the good of the Nation over their Party.
I'm so glad we at FR can keep a sense of humor throughout all this. :)
"So he was arguing that all split ticket ballots must be awarded to the Dem candidate"
Huh? Are you telling me that Arnbeck actually took that argument into a court room?
