Carloads of Muslim New Yorkers, all U.S. citizens, were detained for hours by federal agents after they returned from an Islamic convention held in Toronto over the weekend. A Pace University student said she was asked by a border patrol officer at the Lewiston-Queenston Bridge crossing whether the wire in her bra was a weapon. A white Flushing resident said U.S. officials refused to tell her why she was being held for eight hours.
"It's just appalling," said Jean Tassi, 53. "If I didn't have on a head covering, I would have never been stopped."
A U.S. Customs and Border Protection official said agents acted on intelligence that conventioneers may have terrorists in their cars.
"We understand that most of these conferences are legitimate, but it is our duty, it is incumbent on us to verify the identity of everybody entering the U.S. - even citizens," said Kristi Clemens, a Washington spokeswoman. "I understand their frustration."
More than 30 people had attended "Reviving the Islamic Spirit" convention at the Skydome that was billed as a spiritually uplifting event.
"I refuse to be treated like this in my own country," said Miriam Soliman, 20, a Brooklyn-born finance major who said she was interrogated about her underwire bra.
The officer I talked to said that if there is reason to believe that anyone (including citizens) have "consorted" with criminal elements---they have the right to print and pic.
He said the rule goes back pre-9/11, but was little use till post 9/11.
He said that if a citizen feels that they should NOT have been printed, they reserve the right to file a complaint

My point exactly, there is not a regulation allowing me to do it.
This is from the Inspectors Field manual:
12.1 Inspection of U.S. Citizens.
When you are convinced that an applicant for admission is a citizen of the United States, the examination is terminated. This is not to say that your role as an inspector is always completed at that time. Listing of the subject in a lookout system may dictate further action, such as notifying Customs or another agency of the person's entry.
It must be emphasized that the grounds of inadmissibility contained in 212(a) of the INA are applicable only to aliens. Consequently, the examination of a person claiming to be a United States citizen is limited to matters required to establish present citizenship. Once you are satisfied the person being examined is a U.S. citizen and any required lookout query has been completed, the examination is over.
Temporary detention of a U.S. citizen for extensive questioning generally requires reasonable suspicion that the person is involved in illegal activity. Inspectors cross-designated to perform Customs inspections may, of course, continue questioning for Customs purposes. If probable cause to arrest the U.S. citizen cannot be developed within a reasonable period of time, the person must be released.
Im not questioning the detention or the questioning. No law was broken, no arrest made, so what authority do I have to fingerprint the American Citizen.

If indeed we do, I'd like to know about it, as would my fellow officers and we would like to have the section of law, so when the Citizens start to complain, we can show them.
As I stated in an earlier post, maybe the Patriot Act changed 8 USC, but if it did, it would be nice for the DHS and the DOJ to notify us on the Border.
I already plan on doing that. In fact, I'm heading to work in a few hours, so I'll know for sure as I'll have access to the law books and DHS Intra Net.
Like I said, if they did change the law, don't you think it would be nice of them to inform the entire staff and not just a few?

I've been printed at JFK---and it didn't bother me.
(though the ink was hard to get off) I spent my adult life in the Navy (where I NEVER felt I had signed my rights away!)---if it didn't bother me to get printed (and searched) at the airport--it damned well shouldn't bother some little princess.
Also, feel free to post the proof of when I trashed the Military at any time.

Even the FBI does not have the right to demand prints from a citizen who has not been arrested.
Did you ask what happens if they refuse ?
Did you happen to ask just where these prints and pics go, and of what use they would be ?
