CA: Official facing new inquiry - Criminal grand gury to probe actions of S.J. Councilman

A Santa Clara County criminal grand jury will begin an inquiry next month to determine if San Jose Councilman Terry Gregory should be indicted for allegedly coercing gifts and contributions from local businessmen and others, according to a subpoena obtained by the Mercury News.

The document also reveals, for the first time, that investigators intend to examine loans made to the councilman during the past two years.

Gregory has been under fire since May for allegedly pressuring businesses and individuals for contributions and gifts -- accusations he has denied. Last week, the city council held a censure hearing and formally condemned Gregory's behavior.

The grand jury proceedings raise potentially far more serious penalties: criminal charges that could mean a jail sentence and fines for the District 7 councilman and possible expulsion from office.

In its investigation, prosecutors are seeking information relating to loans and also testimony and documents relating to gifts and campaign contributions that Gregory may have received during his term, which began in 2003, according to the subpoena signed by Deputy District Attorney Julius Finkelstein. The grand jury will begin its investigation Jan. 18.

Finkelstein declined to identify the witnesses being called or discuss the shape and scope of the grand jury investigation.
