One needn't appeal to the Supremes. Their precedent in Bush v. Gore should be enough for a low level Federal judge to invoke the U.S. Constitution over the Washington State Constitution.

What's the Federal jurisdiction in the case? The President is a Federal official. The Governor is a State official.
