"Following in the footsteps of the Florida Supreme Court. Unfortunately the US Supreme Court won't touch this one." One needn't appeal to the Supremes. Their precedent in Bush v. Gore should be enough for a low level Federal judge to invoke the U.S. Constitution over the Washington State Constitution.

Unfortunately the US Supreme Court won't touch this one. What's the Federal jurisdiction in the case? The President is a Federal official. The Governor is a State official.
