Also, it doesn't stipulate she had to violate the oath subsequent to receiving it. She could have violated it last year or when she was 8 years old. Oh well, so much for that legal theory.

You are correct. Criminal conspiracy is an ongoing crime and as long as she continues to cover up her own or the crimes of others, she is part of an ongoing criminal conspiracy. This is what I was thinking of at the time I made my post. In fact, I had a funny feeling about what I had posted and started to reread some of the cases.

Nevertheless, a petition to recall her could be filed on the day she takes offices for those crimes related ongoing criminal conspiracies. The RICO case law is very clear that a conspiracy is ongoing as long as the associates in a RICO enterprise continue to cover it up. The only out, is when someone comes forward to expose the conspiracy.

You are correct. The evidence for their case has been collected. They cannot introduce the lawsuit until a wrong had been committed. If the wrong--the overturning of the winning results giving Rossi the Governorship--is established, then the lawsuit, with all of the evidence goes into play. Then the press will, if they are doing their job, give the public a peek into the manhandling of the election process by Democrat controlled King County.

First, GWB did NOT steal the 2000 election and regardless of the WA governor's race, we are way way way ahead.

-in my opinion, based upon the THE SUPREME COURT OF WASHINGTON OPINION -Republicans could probably get the results tossed by showing that the quantity of reported ballots prior to recount does not match the total quantity of votes.

-excerpt from WSC opinion:

In this context, a “ballot” is a physical or electronic record of the choices of an individual voter, or the physical document on which the voter’s choices are to be recorded. RCW 29A.04.008(1)(c),(d). “‘Recount’ means the process of retabulating ballots and producing amended election returns….” RCW 29A.04.139 (emphasis added). The procedure for recounts is set forth in RCW 29A.64.041, and starts with the county canvassing board opening “the sealed containers containing the ballots to be recounted.” See RCW 29A.60.110. Thus, under Washington’s statutory scheme, ballots are to be “retabulated” only if they have been previously counted or tallied, subject to the provisions of RCW 29A.60.210.

It follows that this court cannot order the Secretary to establish standards for the recanvassing of ballots previously rejected in this election. And petitioners’ call for uniform signature-checking standards (seemingly beyond the statutory requirement that the signature on an absentee ballot be the same as the signature in voter registration files) is beyond the relief that can be afforded in this action.1 Petitioners suggest in their reply brief that a claimed disparity in signature-checking standards implicates equal protection concerns under the privileges and immunities clause of our state constitution, Const. art. I, § 19, but they claim no discriminatory intent. We are mindful that King County rejected a higher percentage of signatures than did other counties, but the record before us does not establish the reason for this disparity, and it could be for factors other than the standard employed.2 We do not take petitioners’ argument to suggest that a claimed disparity in rejection rates of voter signatures triggers some independent right, constitutional or otherwise, to a recanvassing of rejected ballots under a newly developed standard, nor does such an argument come to mind.

The prayer for the boy that passed away really got me. He was a classmate of the son of a friend of mine and prayers were offered up for him at the Moose Lodge while I was there Saturday.

Even though my friend's son was home sick that day, she still got a phone call from both the principal and teacher about what had happened.

Not all public school districts are evil incarnate.

And on that note, I bid you a fond goodnight. I have to be up in about 5 hours and aforementioned friend will be picking me up at 8:00 after al of our children are on their way to school so we can go shopping!!!!

Nothing less than representative government is at stake.

You are wrong. It just means we have to win by 2-3% to win. Considering our candidates are better than their candidates and that our principles are better while they have no principles at all, we can easily do that and stomp out the plague of locusts called democrats.

State Dem legislative candidate in my district won by ONE VOTE about 10 or 12 years ago after a "recount," leading his fellow Dems to give him the nickname "Landslide Jim."

It was a special election as the predecessor had resigned. Only one thing on the ballot: choose Dem or GOP candidate for State Delegate. About 5000 or 6000 votes cast and the GOP candidate had won by 17 votes.

This qualified for automatic recount, but they only recount the absentee ballots and assume that the machine ballots were properly counted.

The 300 (give or take 5) absentee ballots, the only votes to be recounted, were placed in an unlocked box (law required a lockbox). The unlocked box sat on a Dem court clerk's desk overnight.

When the 300 ballots were recounted the 17 vote GOP win turned into a 1 vote Dem win. Highly improbably considering it was a ballot as simple as possible, two opposing candidates was the only issue on the ballot.

Even more galling, the Dem victor lives a few blocks away, his wife is a friend of my wife, and he's been to our house a couple times for large parties.

There are alot of people in this thread that a sounding suprisingly like Democrats.

I vote no recount. If the 8 votes hold true, then the election should be conceded. We stand to gain in the public arena by taking the higher ground and not resorting to recount after recount. If there is fraud to be found it will be found, and if the Democrats have in fact stolen office they will be the ones to carry the burden.

IF this count holds true we only stand to gain from concession.
