Dang, those lawyers are long-winded! I trimmed the footnotes off. Go to the DOJ link at the top to see them.
I think they're trying to say - the right of the People to keep and bear arms shall not be infringed.

I liked this part.
The one thing the government is forbidden to do is infringe the right of the people, who are the source of the militia's members, to keep and bear arms.
Tell that to those lilly livered skallywags of the gun control lobby.

For
much more information about the miller decision itself, see

The really cool thing about the 2nd amendment is that it is the only right that brings with it the protection of that right. Somebody wants my gun? Come and try to take it. They might win but they will take losses.
To: TERMINATTOR
it depends on how far your willing to push it, if you believe that your right is to keep and bear arms, that means that if the gov comes in to remove them (for no reason) then it is well within your rights to ventilate the reprobate.

Also note that "well regulated" had an entirely different meaning in 1783 - it meant "ordered and effecient", not "government oversight".

I read all of it... now my head hurts big time! But I guess it means I can get the FAL out of the gun cabinet, sling it on my shoulder, and go take the dog for a walk. I just hope the neighbors read the same article!

Thanks for posting this! I've been in a debate with a few people over the usage of 'militia' in the 2nd Amendment and individuals rights for the past 2 weeks. Plenty of ammo for me to use here! Pretty well sums it all up, hopefully for everyone.

This is powerful stuff, people. Anyone yammering about how there was no difference between a GW Bush administration and that of John Kerry needs to be hit over the head with this.
Eugene Volokh has a bit on his blog about this.
This is a GREAT thing for the RKBA here in the U.S.

A feature of the Second Amendment that distinguishes it from the other rights that the Bill of Rights secures is its prefatory subordinate clause, declaring: "A well regulated Militia, being necessary to the security of a free State, . . . ." It's not a subordinate clause, it's a present participle.

Although we do not address the scope of the right, our examination of the original meaning of the Amendment provides extensive reasons to conclude that the Second Amendment secures an individual rightTranslation, you can keep a shotgun in your house but forget about changing the restrictions on concealed carry.
