Rescuer in September 11 Attacks Denied Workers' Comp By Michael Gormley The Associated Press Thursday 16 December 2004 Albany, N.Y. - A World Trade Center worker who rushed from home on Sept. 11, 2001, to help rescue victims of the terrorist attack has been denied workers' compensation because he wasn't ordered to the scene by a boss, a court ruled Thursday. The Appellate Division of state Supreme Court ruled in favor of the Port Authority of New York and New Jersey and the state Workers' Compensation Board, and against Christopher Duff's workers' compensation claims for psychological injuries. Duff had won a claim for an unreported amount at two lower-level hearings, but an appeal was won by the state, according to the decision. "The man was the property manager for the World Trade Center," said one of Duff's attorneys, Robert Grey. "We don't understand the finding that he was not in the course of his employment."

Kind of an amazing ruling. This person is only authorized to work if his boss asks him? Property manager has all sorts of things that come up that requires attention that his boss my not know about.

In the article, it says that he was at home when the towers were hit and he decided to go to the scene and arrived just in time for Tower 2 to collapse (whereupon he ran for his life) and he returned for the rest of the week to help in recovery efforts.
The ruling is inane; had the event been a wacko shooting folks in the building, every property manager would have been expected to report to help. Knowledge of the building is a extremely useful thing to have on site.
As to his claims? Yeah, bud, there's a million of your fellow citizens who felt fear. Get over it and stop trying to soak the state.

Besides, why should they pay because this guy rushed out of his house and hurt his own feelings.
