Romania wants Marine for questioning about accident that killed rock star

The Romanian government has requested that a U.S. Marine return to Bucharest for questioning in a Friday night auto accident that killed a popular Romanian musician.

Staff Sgt. Christopher R. VanGoethem, 31, commander of the security detachment that guards the U.S. embassy in Bucharest, is suspected of crashing an embassy-owned SUV into a taxi, killing Teofil Peter, a veteran rock musician and producer, Romanian police said.

Breath tests indicated that VanGoethem had been drinking alcohol, Romanian police told The Associated Press.

VanGoethem, who was not injured, was transported some time after the accident to Marine Security Group’s Company H headquarters in Frankfurt, Germany, a Marine spokesman said on Monday. The spokesman added that VanGoethem was likely to return to his battalion headquarters in Quantico, Va.

But the Romanian Foreign Ministry said in a statement Sunday that it had learned “with consternation” that the Marine had left the country and that it had asked U.S. authorities to bring him back and waive his diplomatic immunity so he could face justice.

The Marine spokesman, Maj. Matthew Morgan of the 4th Marine Expeditionary Brigade of Camp Lejeune, N.C., said the Naval Criminal Investigative Service is investigating the incident. Morgan said that VanGoethem had not been charged with a crime.

NCIS agents were scheduled to arrive Tuesday in Bucharest, according to a U.S. government official in Bucharest, who spoke on condition of anonymity.

The official said VanGoethem “is entitled to certain immunities under international law as an accredited member of embassy staff.” The official said he did not know if VanGoethem was immune from being prosecuted in this case.

The official said that Romanian police gave VanGoethem a breath-analysis test. He added that there was “some disagreement between American and Romanian authorities over who would administer” a blood test. The official said one was eventually administered and that U.S. authorities took custody of the results.

U.S. Ambassador Jack Dyer Crouch said Sunday that the embassy regretted the incident, Romanian state news agency Rompres reported.

Crouch said the U.S. Marine Corps will cooperate with Romanian authorities in their investigation.

A decision on whether to hand over the Marine to Romanian authorities will be made after the Romanian and NCIS investigations are complete, Crouch said.

Crouch spoke to Peter’s son earlier Monday, expressing condolences for the family’s loss, the embassy said.

Peter’s death caused an outpouring of emotion in Romania. In his native region of Transylvania, radio stations played his group’s music all night Saturday in tribute.

Peter was riding in the passenger seat of the taxi. The driver escaped with minor injuries.

According to chart on DOS web site member of administrative and technical staff can not be prosecuted.

However, can VanGoethem face justice in U.S. for impaired driving causing manslaughter?

I believe that perps should be called to account in crimes. But if we send this man back, then we need to get an agreement that if their diplomatic staff is inolved in something criminal here, we get to keep them too for prosecution.

If this Marine is guilty of driving drunk and killing someone, even if it wasn't a rock star, he should be held to account under the law.

He should face the music, if the report is accurate. I've heard this sort of thing happens every now and then in the Japan islands, and they always ship the marine home.

About 20 years ago, just before my brother got married, his fiancee's brother was killed by a drunk driver that turned out to be the son of an acredited Dutch diplomat. They never were able to bring charges or suit against him because of the diplomatic immunity rules of the day.

They did, however, settle with the rental car agency (it was a leased car) to the tune of around $1 million. Not sure about all the details, except to say that the Car Leasing Agency must have been holding a weak hand if they settled for such a large amount.

I agree. But then I don't want one of their diplomatic staff to kill someone over here and then claim diplomatic immunity, allowing him/her to go home scot free. It needs to be reciprocal. It's a problem over here.

There is absolutely no reason why we should act differently in this case and if we don't turn this person over for trial the USA has no right to claim moral authority/superiority in the future.

Absolutely right - any kind of immunity he may have should be waived.

This is a good case that shows how much we differ from liberals, DUers, etc., - if this was some democrat politician/diplomat that got drunk and killed somebody in another country, the liberals, DUers, etc., would be claiming diplomatic immunity. Everybody here in this thread recognizes that the Marine should be held accountable for his actions.

There is absolutely NO reason we should act like Russia. That is globalist speak.

We have miltary laws that cover this, and they will be adhered to.

Moral authority/superiority my fat behind!

Me too, as soon as we get to subpoena Kofi Annan to testify, I might consider letting Romania talk to this Marine, though I doubt that I'll ever think it's a good idea for our military to be tried in foreign court rooms, it's just bad precedent.

Sucks when diplomatic immunity works for our guys (not condoning the Marine's actions if he was DUI).
Either drop it altogether or honor it, people. You can't have it both ways.

Why? When foreigners commit crimes in America we don't send them home to their own countries to serve their time. Why would you expect other countries to send Americans who commit crimes back to America? It is not logical. Do you think you deserve special treatment just because you are American?
