The issue isn't the group bringing the lawsuit...anyone should be allowed to bring a lawsuit...the issue is with the courts who make the decisions. Remember, the ACLU itself has not removed one baby jesus from a town square.

The ACLU cannot work without receptive courts. The two will often work together. Take what happened here in Mass. with same-sex marriage. Ms. Anthony Lewis (who heads the court here) let it be known a few years ago that her court would give favorable consideration to a lawsuit. She was blatant...others not so much.
Nevertheless, this is why we need strict-constructionist judges. Bush, Frist and the Republicans had better deliver.

The ACLU should legally be allowed to bring such a lawsuit. The ACLU and its members are freedom grabbers for doing so.
