Blackwell Sued Over Cuyahoga Vote Tally

A national nonpartisan voters' rights group has asked an Ohio court to reinstate nearly 8,000 provisional ballots ruled invalid in Cuyahoga County.

The People for the American Way Foundation filed suit Friday in the 8th Ohio District Court of Appeals in Cleveland against Ohio Secretary of State Ken Blackwell and the Cuyahoga County Board of Elections.

Last month, a federal appeals court ruled that Blackwell was correct in directing poll workers not to count provisional ballots cast outside voters' home precincts. That was only one of a flurry of conflicting court decisions at the federal and state levels.

Cuyahoga had 24,472 provisional ballots cast in the Nov. 2 election, and 8,099 - fully a third - were invalidated. That was the largest single body of controversial ballots in any of Ohio's 88 counties.

The suit is a mandamus action, which asks a court to compel a public official to perform a duty.

The action charges that poll workers and precinct judges "were deeply confused" about how to handle the provisional ballots and that Blackwell failed to provide clear instructions.

People for the American Way wants the court to order Blackwell and the county elections board to check electronic voter-registration rolls against paper registration records, to notify each voter who cast an invalidated ballot why it was rejected, and to give that person a way to contest the invalidation.

The suit also wants ballots counted if voters cast them in the wrong places and officials failed to send them to the right polling places.

The first line, which describes People for the American Way as a "nonpartisan" group, says it all.

This suit is ridiculous. The underlying theory appears to be that it is impossible to cast an invalid absentee ballot -- or, at least, it is impossible to cast an invalid absentee ballot in Cuyahoga County. None of these "nonpartisan" groups seem to be too worked up about invalid absentee ballots in Bush counties.

I hope the judge looks at this group's Lawyer, says "You are complete idiots. Quit wasting my time and the court's resources with this nonsense. Case dismissed"

Also, the statement, "The suit also wants ballots counted if voters cast them in the wrong places and officials failed to send them to the right polling places."

Why can't this group just come out and say, "We will sue until we find a way to give the state of Ohio to Kerry!"

If this group is so "nonpartisan" they should be challenging results in Pennsylvania, which Kerry won by about the same margin as Bush won Ohio. Leave it to the typically liberal press to inject the word "nonpartisan" into the description of People for the American Way when everyone knows that this is nothing but a Democratic front group.

Blackwell is a Republican and also a prominent African-American politician. Some observers think he will be the next governor of Ohio.

He will. Unless the Ohio Republican Establishment can beat him in the primary.

He was the former Chariman of the Forbes 2000 campaign.

I know. Catherine Harris went through it and now Ken Blackwell. The Dems are in decline. Zell Miller said it well, a national party no more. It left him, he did not leave the Democrats.

As much as I like Watts, the Demoncrats would smear him worse than Clarence Thomas for his extracurricular activities. I'd prefer to see a Condi Rice/Ken Blackwell ticket.

Based on the federal court's decision, the judge should dismiss the case, assess all attorney fees and costs against the leftists who brought it, sanction their attorney for filing it, and refer the attorney to the state bar for disciplinary proceedings.

Drinan is a liberation (marxist) theologist. He is the one that cut the deal with Kerry in order to get the congressional seat. Drinan is currently a full-time professor at Georgetown University Law Center. He typifies the kind of Catholics that are welcome at the university.

I am afraid that as an obvious member of the VRWC, you are ignoring fundamental human rights here. It is disgraceful that in Ohio, as in other states,

many members of Federally Protected Minority Groups
were only allowed one vote apiece, and that only
if they were legally registered

and voting somewhere near where they resided at the time, or received one measly absentee ballot mailed to an actual address where someone resided, perhaps even the named, live voter. It all adds up to Suppression of the Minority Vote!

After the many hundreds of years of oppression suffered at the cruel hands of white men, surely these FPMG people should be allowed to make up for the missed votes of all those lost generations by casting as many ballots as possible for the Democrat Party and Democrat candidate of their choice.

But, after re-reading your barbed sally, I must sadly conclude that you are one of those pettifogging would-be tyrants who, true fascist to the core, also insists on voters being alive at some point close to the election.

Do you not realize that if a Republican wins an election, any election for any position, the Emancipation Proclamation will be repealed and that many hundreds of women and children will immediately starve, sicken, and die? How can someone as insensitive as yourself, sir, possibly sleep at night?
