Judge Charles Pickering could learn soon whether he'll be confirmed for a federal appeals court post, a doubtful prospect for the jurist accused of being racially insensitive and anti-abortion by Democrats in the U.S. Senate.
If the Senate doesn't confirm Pickering before it adjourns in December, he'll be forced to retire from the 5th U.S. Circuit Court of Appeals in New Orleans, a post he currently holds by a recess appointment.

The President will re-nominate Charles Pickering. And this time Bill Frist will be told by the White House to put up or shut up.
WHY would he not be appointed permanently?
Are you trying to say that we have mostly RINO's in office now that are no more than TAX & SPEND liberals?
Can Bush give him another recess appiontment?
Do you really believe that?... It would be refreshing for Frist to be forced to act conservative instead of just mouth conservative.
And the Stupid Party will turn to mush, fold up its tent, and life goes on. 'Tis not fun to be a conservative!
If the Democrats block him again, any reason why Bush can't give him another recess appointment?
Now that Daschle has been well... daschled, there's no excuse for the Senate GOP majority not to step up to the plate. They have four more members than they did two years ago.
"accused of being ....."
We don't have to put up with the slander now.
Take the time to set the record straight and press on with the vote.
If they don't vote on Pickering...BRING BACK BORK!
Goldstategop is right. It is time to put up. Screw recess appointments. Bush has political"capital" and he needs to demonstrate that ASAP!
Actually, being anti-abortion would seem to make Pickering racially sensitive.
It is he who is against the wholesale slaughter of minority children in the abortion chambers.
Put the heat on Landrieu. She campaigned that she wouldn't hold up judges and this one is smack in her district.
There are a few other dems from moderate states that may not want to fight every appointment after seeing what happened to little Tommy. Harry Reid may be a tad sharper but we'll have to wait and see.
This will give Specter his first chance to prove himself to the Republicans.
Renominate Pickering.
He will be BORKED based on RACISM, no bias against his pro life stance there. Just ask Specter.
But in January we will have 5 more Republican Senators and 4 fewer Democrat Senators. Don't call the game over just before our reinforcements arrive.
Can Bush give him another recess appiontment?
The real game is just beginning. I'd like to see a smackdown of Specter, and those that supported the Daschle tactic of tying up appointments in Committee right away.
The Pickering nomination never should have been held up in Committee as it was. From what I have read he (Pickering) is a decent, and competent Judge.
I like the idea that President Bush could flex a little bit right now and the liberals and RINOs can squirm over it.
The Sheriff may not be new, but he has a lot more capital right now. I see no point in waiting to invoke it. Let the real Games begin.
Last time, it was "reported" that Mr. Pickering could have only one recess appointment. So I presume that he will retire in January: there is little likelihood that the popular NV liberal Harry Reid will be any easier to work with than was the surprisingly unpopular Tom Daschle.
Time for Specter to pay up.
