No. The judge is in charge of keeping order. No gum chewing, no inappropriate attire, no cell phones. She got a warning. She needs to learn how to accept authority.

You're absolutely right. Even if she had it purposely go off, which I seriously doubt, she probabley didn't realize it was on, like she said, you just take the phone away, and go on. So what if she's an idiot. You can't give a person three weeks in jail for a cell phone ringing that's rediculous.

That still doesn't excuse him giving her three weeks. I can understand making her give him her phone, and litterally crushing it with his foot. That is probabley what I would have done, but to sentence her to three weeks is just unacceptable.

Iset my phone on vibrate and keep it in my front pocket, so I don't have this problem.

The thing is, cell phones aren't supposed to either be on or even be in certain areas and I'm sure this teenager has had time and opportunity to figure that out. I couldn't carry on into my last exam. You can't have them on in class. In that situation, the teacher can make you feel stupid for having it on. But in a court of law where the judge has descretion for what happens to you and has already warned everyone about the phone? Better suck it up and learn how to turn off the damn phone. Standing before a judge is a lot more serious than being in the military.

What? Is English your second language?

Are you confusing Contempt of Court with Assault? I strongly suspect the judge could keep them straight, and you'd get far more than 21 days. You'd probably serve your time in prison, rather than jail.

I trust you can appreciate the distinction.

Yeah, I'm definitely in agreement with a few of the others on here. What this judge did was overkill and unacceptable.

It's sickening to see this slavish obeisance to authority figures that some people on this thread apparently have. No wonder we're in some of the messes we're in today when you carry around this devout "authority knows best" attitude. And no wonder some people on the left call conservatives fascist.

Sometimes the phone doesn't go off...

And the reason the phone didn't go off is because nobody turned it off.  Everyone in the court room knew how to turn their phones off because the judge furnished universal instructions (use your heel).  Court rooms are not places for excuses like "the phone doesn't go off".  Sooner or later everyone has to learn to wipe their fanny, not play in the street, and know when to sit and be quiet.

You know how many times I have shut off a cell phone and it either came right back on and I accidently failed to fully depress the button?

Perhaps your mother should take your cell phone away until you learn how to turn it on and off. Maybe your computer too!

Indeed. I have had a cell phone for years and I have NEVER (yes, never) had it ring in a court, a movie theatre, a restaurant or in church.

Every phone I have ever owned has had a screen that shows whether the phone is on or off. And once turned off, I've nNEVER had one turn itself back on without my permission.

Watch how the phone owner reacts when his/her phone rings in an inappropriate place. Do they answer the call? If they do, then they really intended to have it ring. A truly embarrassed person who did NOT want the phone to ring would simply push the talk button on, then off again without answering the phone.

First language. I was born in Iowa and believe it or not, Enlish is my first language. Now, spelling and punctuation are an entirely different matter.

Perhaps I should have said "I couldn't carry one into my last exam."

California administers a test called CBEST for substitute teachers. There are multiple written and oral warnings NOT to bring the cell phone into the test room.

Even after coming into the room, the greeter gives you another chance to put your phone on the desk and they help ensure the phone is off.

Then the proctor comes in and says that anyone that has a cellphone that rings will be automatically ejected and receive a zero on the test. That is when the phones start coming out of the purses!
