Failed presidential candidate John Kerry is considering filing a libel suit against the leader of the group Swiftboat Veterans for Truth, John O'Neill, whose book "Unfit for Command" is credited with capsizing Kerry's Vietnam-based campaign.
"I don't know if they will actually go forward," a member of Kerry's inner circle told New York Post's PAGE SIX, edited by Richard Johnson. "But consideration is serious. If Kerry plans on running again in 2008 and I'm hearing he will it would make sense that he'd file the suit."

That, plus the fact that as a public figure, Kerry would have the formidable task of trying to prove that the SwiftVets knowingly told a falsehood about him in order for him to prevail.
Thus, this announcement is some sort of PR ploy that will never actually come to fruition.
Exactly. For libel, you (the plaintiff) have to prove that the defendant is wrong, which would require full disclosure of the facts in dispute.
Bringing suit does not mean the want to go to trial.

They might be just trying to make them spend money, to make them go through some emotional torment for the length of the suit, to get publicity, to have planned releases of 'leaks' to the press about things that are FALSE just like they did with Ken Starr.

Just because you ASK fo the documents, that does NOT mean you have to gie up the documents in the discovery process! It depends on the judge!
TRUST ME! You can ask anything,all the plaintiff has to do is say something like:" We will reveal that at the trial"...
and VIOLA! Discovery question answered!
There should be a class action suit against Kerry, by ALL Vietnam vets who were hurt by what he did to them.

Oh, I think he's doing just fine. He's well on his way to where he needs to go.
O'Neill would probably head up his own defense team (he's a very accomplished lawyer in his own right). He could depose/cross-examine Kerry directly.
'Discovery' is not just a channel on tv.:)

The Swift Vets and John O'Neill, a very intelligent lawyer, have always made very clear what they know and what they don't know. They have never made unsubstantiated charges, as they have been very very cautious and prudent in the charges they have made and have always backed them up with facts. Whenever there has been any doubt about anything, they have made it very clear what they know and what they don't know, and have never made wild unsubstantiated charges. And they have always said that any questions they had could be cleared up by Kerry signing a 180. Of course, he never did as he knew the Swifties were right. No way would this traitor ever allow himself to be put under oath and go through discovery.
This threat to sue is total BS as he would have done it before the election if he were going to do it.

Kerry .......... the gift that keeps on giving. He cannot be so sick and foolish to sue........ but we can hope so, I guess. What entertainment that would be!!!

I'm thinking that he could actually file the suit, get the publicity, let it hang on a few days then withdraw the suit and claim that "we have reached an agreement," or some such.
The publicity for "outing" the scandalous SwitfVets is what he really wants. After the seed is planted there is no longer a need to water it in this instance.
