I am being sued for something that happened at the December 2000 Freep of Joe Lieberman.
JimRob has allowed me to hold an internet fundraiser to help defray the costs of my lawyers fees.
I am broke and thousands of dollars in debt, and depending on how much I can collect here, I amnot sure if I can continue or work to sign a mutual release if offered.
Right now, we have ended the discovery phase, and are awaiting the deposition of the man who accused me of assaulting him that day.
That charge is a lie.
The following story below is my short account of what happened that day.
Also, I am not an accountant.
When I got the 10,000.00 cashiers check from my grandmother, it had the word "GIFT" typed in the memo field. It was explained to me that "GIFT" had to be on the cashiers check for tax reasons.
I deal with this all the time...I hope W fixes it permanently.

What kind of man sues for assault unless he was severely injured for no good reason.

It is irrelevant whether your hand was on his chest or his throat, because you were defending against a trespass and an assault (as opposed to a battery), and therefore had every right to defend yourself and property with reasonable force. Even using Kimber's version of the facts, it shows that the force you used was eminently reasonable.
IMO, with an $8,000+ legal bill and a three year long case, your lawyer is taking you to the cleaners. This could have been easily resolved at the very first hearing with a motion to demur to the complaint. That's where your lawyer files a response that says Plaintiff's complaint failed to state a cause of action because the conduct alleged (the touching of Kimber) was perfectly lawful self-defense, and is therefore not actionable. And if Plaintiff seeks leave to amend his complaint, you point out that if he does, that you will be forced to file a counter-suit for assault, trespass and harassment.
But all the opinion and advice in the world, won't pay your bills, so Mrs. Boot Hill and I will be contributing to your legal defense fund.

bourbon is a young lawyer with a good firm.
i'm old school...I use lawyers for real estate, taxes, estate planning and criminal matters. I've been in dozens of fights in 46 years and lawyers have never crossed my mind for civil suits.
I did use one to collect money once though.
