Arlen Specter, just one day after the historic Republican victory at the ballot box has warned the president not to nominate judges that are too pro-life or too conservative. The arrogance and sheer audacity of Senator Specter proves that he, despite any claims of seniority, is unfit to Chair the Senate Judiciary Committee.

Voters sent a clear message of support for the President's agenda, and he deserves a Chairman that shares his views of the judicial nomination process, not a maverick seeking to impose his own beliefs on the court.

Bork was just interviewed on FNC, explaining that he would not rather be considered an emblem of the abortion issue. Instead he contends that he stands for the Constitution, which takes no stand upon the issue -- for or against. If Roe were overturned, he went on, abortion would not become illegal. The issue would instead revert to the states where elected legislatures would deal with it as reflected by popular will.

He further explained that the Left is finding it increasingly difficult to win elections, so they prefer to have issues settled by justices who would function as robed Philosopher Kings. The hope is that they would then impose laws that the electorate will not support and countermand the ones that are deemed by Our Betters to be inappropriate.

[Clearly this conspicuously anti-democratic use of SCOTUS is NOT the intention of the Framers.]

Appointing someone who would not play along with this strategy is seen as a clear threat to this plan, so it should be no surprise why the Left becomes so hysterical when a Constitutional jurist is considered for the bench.

Here is something else to consider. In the 1992 Supreme Court case Planned Parenthood v. Casey, the Supreme Court had an opportunity to overturn Roe v. Wade. Chief Justice William Rehnquist and Associate Justices Byron White, Anthony Scalia, and Clarence Thomas voted to do so.

Those who voted to uphold Roe v. Wade included Associate Justices John Paul Stevens, Sandra Day O’Connor, David Souter, and Harry Blackmun. It was Associate Justice Anthony Kennedy who would cast the deciding vote in the case. Kennedy was initially going to vote to overturn Roe v. Wade but ultimately caved in to pressure from pro-abortion groups and voted to uphold it.

Kennedy should never have been a judge in the case. He was appointed to the Supreme Court only after the man nominated before him, Judge Douglas Ginsburg, was voted down by the Senate after admitting he had smoked marijuana in the past. And Ginsburg was only nominated because the man nominated before him was none other than Robert Bork, whose fate we already know. If not for Arlen Specter, it would have been Bork, not Kennedy, casting that deciding vote.

Thanks to Arlen Specter, one golden opportunity to overturn the atrocity that is Roe v. Wade has already been squandered. Can we really afford to put him in a position to do it again?

Remember: those who do not learn from the past are doomed to repeat it.

With 45 million babies dead and counting, perhaps it is time we informed Senate Majority Leader Bill Frist of the folly of giving Specter the power to replace Tom Daschle as obstructionist-in-chief.

I cannot comprehend why certain FReepers are being so gullible, telling us to just "trust" Bush on this. Roe V Wade would already be history if not for Specter!!!

We New Yorkers did not go the way of Bush-Cheney - they lost here by more than 1 million votes. New Jersey and Connecticut also said no to them. And the West Coast turned against the incumbents. (As did much of Europe, where, typical of the reaction, The Daily Mirror in London asked in a front page headline, "How can 59,054,087 people be so DUMB?")

So what do those of us who opposed the President do now?

... Arlen Specter makes me optimistic. A Republican who is set to take over the chairmanship of the Senate Judiciary Committee, he's telling the Bushies that he does not want to see judicial nominees who are extremists from the right.

The one that worries me the most about Spector is this quote from him:

"My Senate record of independence has demonstrated my willingness to break with my party. I had no hesitancy to oppose Judge Bork where I was convinced he was far outside the constitutional continuum or mainstream because his insistence on "original intent" presented a real threat to constitutional construction representing the consensus values of our society."

Original intent is how the justices are supposed to look at the Constitution...evidently Spector believes in the "living document" side of things. What he means by "consensus values" is beyond me.

Constructionists believe that the Constitution can be amended outside of the specified process by activist judges and elitist legislators who do not want their edicts to be subject to a popular mandate.

Just listened to Arlen Specter on Hannity. The man is pure BS. He said that he opposed Bork because Bork did no follow the Constitution. And, then Specter said that he was “Pro Abortion”.

Specter stated that he was opposed to “Government” getting involved in the “Bedroom”.

What do abortions have to do with the bedroom? Abortions are performed in clinics. Abortion is not a sexual act.

As for following the Constitution, where in the Constitution is the clause that authorizes the Federal Government to address the issue of abortion?

The 9th and 10th amendments make it clear the States should address the issue of abortion.

Contrary to Specter’s words, his actions make it clear the he thinks that he Federal Government should be managing the lives of every person in the Country. He needs to be brought down.
