Woman struck by train sues railroad

A Jeannette woman who was slightly injured after being struck by a train while walking along railroad tracks sued Norfolk Southern Corp. Thursday for failing to warn pedestrians that trains travel on tracks.

Patricia M. Frankhouser, of 910 Scott Ave., is seeking an unspecified amount in excess of $30,000 from the Norfolk, Va., rail transport company for the Jan. 6 incident that left her with a broken finger, cuts on her hand and pain, according to the suit.

Greensburg attorney Harry F. Smail Jr., who represents Frankhouser, didn't return a call seeking comment.

Within the filing, he argues that the railroad was negligent for failing to post signs warning "of the dangers of walking near train tracks and that the tracks were actively in use."

Erm, ah....

We had a family friend who was driving REAL fast on a country road at night. As he approached the RR tracks, he flashed his high beams to see if there was a train coming. All he saw was pitch black.

So he hit the gas.

He quickly discovered the train had already crossed the intersection the moment he slammed into the side of a boxcar.

He lived, but he didn't sue. Why advertise your stupidity?

I have told everyone I ever met that, if there is no rust covering the top of the rails, there will be a train coming through.

Expect a train on any track at any time in any direction. The tracks can look rusty after just a few hours in the right conditions.

I managed to survive 2 years of working on AMTRAK's high speed rail electrification project with that logic. A 150 mph electric train can really sneak up on you, especially with drill rigs, compressors & generators running all around a guy who is wearing hearing protection.

First I thought it was stuck by a train, then I would sue big time!!
Trains always slow down when I'm stopped by them!!

However I walked on RR tracks to get to high school, even a 14 yr. old knows to get out of the way of a train!!!
