A Morgantown man accused of flashing a woman on the Caperton Trail in July will undergo a psychiatric evaluation to determine if he is able to stand trial.
David M. Martin, 23, of Donley Street, is charged with two counts of indecent exposure, stemming from two incidents on July 10.
Before his scheduled trial Monday afternoon in Morgantown Municipal Court, his court-appointed attorney, Ed Rollo, requested a mental evaluation for his client.
City Attorney Brent Burton agreed to the request and the trial was postponed.
Rollo told Judge Stephen Higgins he planned to file a motion for competency in Circuit Court on Wednesday, since the court wouldn't be open today, Election Day.
Martin remains behind bars at North Central Regional Jail on $1,000 bond, a jail spokeswoman said on Monday evening.
Before the hearing, Martin repeatedly asked officers what time it was, and eventually asked Morgantown police Officer J.K. Ammons if he would be getting out of jail that day.
"I doubt it," Ammons said. "If you'd keep it in your pants we wouldn't be here in the first place. How would you feel if your mom or sister came to you and told you that happened to them? You wouldn't like it, would you?"
Looking directly at the officer, Martin responded, "No." He remained silent after that.
Following Martin's evaluation, Higgins said, a status hearing will occur. If Martin is deemed competent, a trial date will be set. If Martin is not found competent, Rollo said his client may be committed to a psychiatric facility for treatment.
Martin was arrested for false pretenses on July 12 because he didn't pay a taxi cab fare, Monongalia County Sheriff's Department Chief Deputy Al Kisner said.
After deputies arrested Martin, they discovered there was a warrant for his arrest, stemming from July 10, when a 30-year-old woman said she noticed a man, later identified as Martin, walking with his private parts exposed.
Martin earned a second charge when he reportedly exposed himself to a female officer while in the custody of sheriff's deputies.
Martin was arraigned July 15.
