At first I thought the guy is wrong. Then I read your post and you make a lot of good points. They should let the guy go and live his life. He has already done his time.

What is fundamentally being questioned here it the authority of a stop loss

I just looked at my original enlistment contract, it states that in time of national emergency I may be involuntarily extented.

Assuming this guy has the same deal, he's SOL.

This is the same thing that happened in WW2. There is plenty of precedent for it. Also, in Korea lots of officers and enlisted men were called back in whether they wanted it or not. If the guy didn't want to fight, he shouldn't have ever signed up. Simple as that.

Confessed subway vigilante Bernhard Hugo Goetz replaced his lawyer today with two other attorneys, including one who has been mugged twice. The new lawyers, Joseph Kelner and Barry Slotnick, said they will defend Goetz for free.

Slotnick is a criminal lawyer who has defended Mafia suspects in the past. He said he would argue that Goetz acted in self-defense.

Aniello Dellacroce, identified by authorities as the No. 2 man in the largest of New York's five Mafia families, the Gambino family, has died at 71.

His lawyer, Barry Slotnick, said Dellacroce died late Monday at a hospital which he did not identify. Dellacroce had been suffering from cancer and heart disease, he said.

Sukarno's New York attorney, Barry Slotnick, said his client has endured a year of shame and humiliation and is remorseful.

I'd say he did get a response.

He got his honorable discharge - the Army decided that he resigned properly, and had his 8 years in. Weird how they wouldn't acknowledge that he did everything properly until it went to trial.

I'm not going to criticize him because it looks like he held up his end of the bargain.
