Nah. The harassed person has an obligation to advise management of a problem. Management isn't expected to be (and can't be) precient. FoxNews is okay in this, and her lawsuit won't prevail.
-IF- the allegations are credible, the material harm, if any, would be to O'Reilly's ratings. If the ratings stay put, or dip only a small amount, worst case for Fox is to pay her off to go away.

Which is what I think part of her lil money grubbin mind had preplanned all along. The other stories of her allegedly being sexually harrased at CNN and/or CNN using her as a tool to jack FOX around, either way she appears to have preplanned for "her" BIG PAY DAY. I haven't met her and already am under the impression she doesn't like working period. I think she brought up Caribbean nights, fantasizing about spending part of that whopper $60 million dollar win-fall (LOTTO LIBERAL STYLE) LOUNGING ON A WHITE SANDY BEACH with a cool drink in hand.
