O'Reilly in trouble!
Try more like Freepers said that there was plenty of reasonable doubt and reasons to question the motives of the accuser.
That, and the stuff later when they're talking about Al Franken, and how it "goes all the way to the top" (Bush/Cheney) - frankly, after looking at this, I think they're both full of it.
This is a legitmate filed complaint. Index No. 114558-04
Holy crap. She may have him dead to rights..... If she's got tapes, he's a goner.
Wonder if he'll investigate himself like he said he would with the Dan Rather forgery?
Legitimately filed. Sure. But doesn't mean it (the case) wasn't made up.
I don't know. So far in my distracted reading of this (I'm on page 7- w/people coming and going in and out of my office) I don't see anything other than what we get on TV on a daily basis from him. He can be crude, over the top, impulsive, but I don't see any proof that he treated her any differently than he treats anyone. By the way, I've suspected bipolar disorder for awhile, but that's just my impression.
What we have here are two people who are hard to like. But I think she is the one I like least because I think it is most likely at the end of the day, political. I think she is a Michael Mooron.
As a lawyer, here is my take:
He is toast, she has tapes. She did not allege the tapes because she is setting the perjury trap for him. His complaint against her essentially does not deny the allegations, but says she has no claim under sexual harassment law because she did not complain to "upstairs" first.
Trust me, he's a goner.
Her Lawyer:
But somewhere along the line, while he was scoring the largest verdicts in legal history for blindness in one eye ($2.25 million), multiple fractures ($11.1 million), and the death of a pregnant woman ($41 million), Benedict Morelli made the decision to rise out of the personal-injury ghetto. Now he wants a shot at social-justice cases, white-collar-scuzzball cases, employee-discrimination cases -- change-the-world cases. He believes he's earned it. And soon enough, he believes, he'll prove it -- by championing a poor little rich boy who lost his Wall Street job after posing, penis erect, in photos that turned up in the June 1998 issue of Playguy magazine.
It reads like a political ad.
First, O'Reilly doesn't seem all the stable. So anythings possible. Second, this is what modern feminist women do: they use their brain when that is convenient. But if their body can give them an edge, they will use that. As long as things are going well--job is secure with regular pay increases--then there's no need to mention sexual items. But if things go wrong, then the inappropriate sex talk, etc becomes an ace in the hole.
There ought to be no fraternizing in the job place. Any man or woman who does is playing with fire and ought to be fired.
I wonder how O'Reilly's wife is going to react to the vibrator comment he makes about her? He could have a lot more trouble than just a lawsuit.
I read through the thing, and I'm having a tough time believing this thing isn't going to be instantly tossed as a matter of law.
She claims "discrimination" but does not cite a single instance of it.
She claims a sexual harrasment "qui pro quo" but never shows in any way how this could be the case. In every instance she claims not to be returning his advances, yet she receives multiple raises, is re-hired after she leaves for CNN, and is given a plum assignment at the Republican convention.
She talks about a "hostile work environment", but almost every instance she refers to takes place outside of work, and she doesn't appear to have complained to anyone at Fox regarding the behavior.
Finally, she claims "damages" but never cites anythign specific to base them on. No loss of income. No psychiatric diagnosis. Nothing.
It's hard to see how this is going anywhere in court.
"That would make a good pick-up line for an Irishman."
At least he didn't tell her she was "magically delicious"!
I agree.
"But if it is NOT true do you still wish for O ill? I think so."
---BO is just an egomaniacal windbag and it'll not hurt my feelings at all to see him sink down the tubes for basically stringing republicans along just enough to boost his rating and books then do a complete 180.
Alright!

You are right - there is no LEGAL merit to her claim. That is the real basis for O'Reilly's action against her - that she should have known that there was no legal basis to sue and thus was extorting him.
The facts alleged, however, I think will prove to be true and captured on tape.
Not if she has tapes, although state wiretap law may come into play.
