It's not about the voracity of the story anymore with Kerry and the DNC - it's how they react. They threaten Sinclair broadcasting? They threaten bookstores, publishers and TV stations over SBVT with lawsuits? Kerry was asked about Unfit for Command - he said he never read it but it's a pack of lies. And on and on...

Would there be any equivalent to a civil or criminal docket book that the BCNR keeps that would list the officers who would have heard this review?

Are the results of these hearings sealed? Or would the docket be a matter of public record like with a civil or criminal case in state or federal court?

Would there be any way to figure out where this review is held?

No. He wouldn't have suffered any consequence, other than to his self-esteem, to have received a General. I had plenty of sailors who served under me who, for one reason or another, weren't awarded an Honorable classification of service (and the corresponding reelinstment code on their DD-214s) at the expiration of their active duty commitment.

Most of them petitioned the BCNR within three years of their fulfillment of service obligation (active duty time plus IRR commitment) and got their discharges raised to Honorable. It depends on the circumstances surrounding the original classification.

BCNR results are generally not subject to "sunshine" or public review for the reason that the characterization of a servicemember's service is basically changed, and the clock is turned back as if nothing had happened to affect it in the first place. Would would be the point of giving him or her a new leaf, if the old leaf was still out there, fluttering around? ;-)

It's almost like a juvenile, who has a record, and who has it expunged upon turning 18. Those proceedings are also not subject to FOIA requests.

It's going to be very hard to shake loose any records existing on this proceeding, if in fact he had a formal hearing and was not just "rubber-stamped" as a result of the Carter blanket amnesty.

Thanks. Can you think of any reason why he would go to all the trouble to hide a General discharge from the public? In his case it would just be too easy to explain away considering his past with the VVAW.

Also, one can go back at the sections cited in Kerry's discharge letter (United States Code) and look them up on the internet and read what they pertain to.

I think that USC 1552 pertains to the BCNR's statutory authority, and the other ones cited in the letter would give you an idea of the reason behind his discharge taking place in 1978 vice the early 70's, as it should have been.

I am just trying to figure out any way to get to those records and get around the 180. But what you said makes total sense.

I guess I am grasping at straws to try to figure out if there is someway a reporter or a member of the pajamahadeen could get someone on the Board to talk about the proceeding if they were dilligent enough. (Not that the officers would likely talk, but it's worth a shot).

It saddens me to think that Kerry might get away with this.

Well, since his election to the Senate in '84, he's projected himself as a sort of war hero and warrior type.

It would hardly look good for him to now have to explain, in the heat of a presidential election, just why it is he couldn't even attain an initial discharge characterization of "Honorable", which for officers (which is what I myself retired at in '99....though I started as a young enlisted man :-) is truly the only characterization that's acceptable.

The man's a United States Senator. Even a peacenik like George McGovern, or Tom Daschle even, got an Honorable discharge from the armed forces.

I think we had done that on another thread a few weeks ago and determined that his discharge may have been other than honorable, but were having a heck of a time figuring anything else out without him signing the 180. I'll look up the code sections and post them in a few minutes.
