September 16, 2004 -- WASHINGTON Congressional leaders yesterday put the kibosh on demands from a powerful House Republican for a probe into "evidence that CBS News has aided and abetted fraud" by peddling suspect documents critical of President Bush.Rep. Christopher Cox (R-Calif.), chairman of the Homeland Security Committee, sought the investigation "given the shortness of the time between now and the election, which the apparent fraud is meant to influence."
He complained the network has declined to give the source of the documents.
But fellow Republican Joe Barton (Texas) rebuffed Cox's demand, saying an investigation "hardly seems appropriate or necessary."
Barton, who heads the House panel that oversees the telecommunications industry, said the court of public opinion will issue the best verdict.
"I do not personally believe these documents are legitimate, and it seems clear that the press and the two presidential campaigns are properly dealing with that issue," Barton said.

Actually a good strategy is to have back and forth hand wringing on whether a congression enquiry is in order (don't do one though ) just to keep the press hot on it and ensure the CBS fraud play in the forefront of news stories for the next several weeks.
That's how I thought of it, furthermore Congressional hearings before the election might throw the election to Kerry.
The Congressional Republicans might learn a lesson from President Bush by staying above the fray at all times. There's nothing to be gained from stepping into the middle of this fiasco.
Cowardly GOP Bigwigs. Why are they afraid of holding the liberal media accountable for fraud? They let CBS get away with this, you can be sure there will be more corruption and fraud in the future.
No sense making CBS look like the victim. I truly believe that's what everyone at CBS hopes happens.

Everyone knows that criminal conduct isn't a protected 1st Amendment right, and nobody is arguing that. I don't know why you bring that up - you certainly aren't telling anybody anything that they don't already know.
A congressional investigation at this time makes this into the GOP vas the press, which is something we don't want. It will be characterized as I said, regardless of the validity of teh characterization.
The AG office, or maybe the FCC, may be well suited to investigate wuith a much lower profile. They can do the legwork in private and then decide if any laws were broken, and proceed accordingly, without it being a media circus that Congressional Hearings would bring.
Don't be that dismissive about the american people.
I said a congressional hearing isn't wise, but that doesn't stop us from making it a point, nor the news media. CBS's rivals have not covered for them much in this case, and I don;t think they will.
All I am saying is that a congressional hearing isn't wise in this case.
