I have the same one you have and I can find no enumerated power in there for the federal government to be involved in murder. Please reference it for me.

You have a point. It would be up to the states to ban partial birth abortion. I was shooting from the hip here. It's a barbaric procedure and should be banned, but it would be up to the states. It's the same thing as the fed gov trying to pass laws regarding "violence against women" and other such things that they do not have the constitutional authority to do. But, we've gotten to the point where the Constitution means whatever some judge says it means, and the Congress in spite of pledging to uphold and defend the Constition, goes right ahead and ignores it.
Congress has the power to regulate interstate commerce, which the med profession is involved in. The 14th Amend guarantees fed rights. The right to life is the most fundamental of those. W/o that, there is no other.
If a state legalized infanticide you think the fedgov has to power to stop it?
At any rate the 14th amendment makes fedgov involvement in the prevention of murder (aka PBA) constitutional since the newly born baby is being denied its right to due process. Not to mention being deprived of life.
