So the blind, anti-eugenics, Catholic, Republican (Al D'Amato appointee), Georgetown U. Graduate and member of the Knights of Malta chooses to keep Partial Birth Abortion legal ?!
On a good note he did ask pertinent questions regarding the hideousness of the procedure and outcome.

now all we need is some congressman with some "nerve" to use certain powers granted to them by the US Constitution and limit the jurisdiction of SCOTUS and use the lower (non-required) federal courts on a need-be basis.
There is always Article III Section 2 of the US Constitution
"The judicial power of the United States, shall be vested in one supreme court, and in such inferior courts as the Congress may, from time to time, ordain and establish......with such Exceptions, and under such Regulations as the Congress shall make.
The drafters of the Constitution gave Congress the power to limit federal jurisdiction to provide a check on out-of-control federal judges. In other words, the federalist concept of checks and balances applies to the judiciary just as it does to the legislative and executive branches.

If Bush wins and appoints a couple of Justices the Democrats might go along with limiting the Courts jurisdiction knowing that they would have little to gain and possibly much to lose with a conservative judiciary.

You're probably right, I wouldn't put it past them.
I wish the republicans would show some fortitude and do something about these courts.

Really Askel, most of us realize things are pretty bad. It is not necessary that we all see things at the same level of difficulty or at the same level of difficulty you do, to be motivated to fight back.
In fact, if everyone viewed reality the way you did, they might not want to get out of bed in the morning.
But the fact that reality might be difficult to stomach is not necessarily the reason everyone doesn't agree with you. Some people might just believe you are wrong.

It's far better to view reality than to participate in a pipe dream. That way -- like me -- you always still have choices that actually mean something. You're not really satisfied with less.
Trust me ... it's not a bad way to go as a rule. Though I do like to sleep in ... always have. About the only thing that has my feet on the floor in a flash is when my Dad used to whisper: "Ya wanna go fishin?" You snoozed, you lose'd.

It will come about the same way it came in. With a complete reversal of Roe v Wade in one sweeping act. All that reversing Roe v. Wade would do is allow the states to pass any laws regarding abortion that they see fit. Reversing Roe v. Wade would not outlaw abortion, in of itself.

Partial Birth Abortion NEVER aids the life or health of the mother!
Stopping the birth process to execute the baby ONLY INCREASES THE RISK TO THE LIFE AND HEALTH OF THE MOTHER!

The judge is following firmly established, but bogus, Supreme Court precedents. The Supremes need to overturn Doe v. Bolton, I think, to limit the health exception so that "she would be upset if she had to carry the child to term" does not justify an abortion.

that just isn't true.. My cousin in Ukraine was pregnant 5 years back, on the fourth month her kidney started rapidly deteriorating. Baby was healthy but if the pregnancy was to continue both her and the baby would be dead. It was a huge personal tragedy for her and her husband. For a long time they considered if they should try again. They decided to risk it and had a son last year. This time pregnancy went completely fine.

If the abortion was in the 4th month, it was not a Partial Birth Abortion.
PBAs are performed from the 6th month on, WHEN THE BABY IS VIABLE OUTSIDE THE WOMB!
So, I repeat, stopping the birth to kill the baby, while only the head remains in the birth canal, is MORE DANGEROUS than continuing with the live birth.
