Prosecution witness once believed there were co-conspirators

REDWOOD CITY, Calif. Police investigating the disappearance of Laci Peterson once thought that more than one person may have been involved -- including her husband's former mistress.

Investigator Steven Jacobson says that was one of the reasons he wrote in affidavits to get warrants to wiretap Scott Peterson's telephone conversations. In one of the affidavits, Jacobson wrote "there was no way one person could have done that to Laci Peterson."

This testimony may foreshadow a portion of the defense case that Scott Peterson had nothing to do with the murder of his pregnant wife.

August 26, 2004 -- REDWOOD CITY, Calif. — A month after Laci Peterson disappeared, her husband called a real-estate agent several times to see if he could discreetly sell their house.

"Kinda keep it quiet, all right?" accused killer Scott Peterson asked Brian Argain on the afternoon of Jan. 22, 2003, four weeks after the Christmas Eve disappearance of his pregnant wife.

"Oh, I will. I'm not gonna say a word to anybody. Don't worry about that," Argain said.

At the time, investigators were still trying to find his wife, and relatives were hoping that she would be found alive — to return to her home, which she decorated based on the tips of Martha Stewart.

But Peterson was apparently trying to unload the dwelling, and spoke to Argain again Jan. 27 and Jan. 29, according to wiretaps played at his murder trial yesterday.

In the latter call, Argain warned Peterson he might need court approval to sell the house without a signature from Laci. .......

The prosecution in the Scott Peterson murder trial played more audiotapes Wednesday demonstrating seemingly bizarre behavior for a man suspected in his wife's disappearance.

On the new tapes, Peterson apparently lies to his mother, telling her he is in Fresno on January 11, 2002, when the cell phone tower that transmitted his call shows he's in the area of the Berkeley Marina. At that time, divers were scouring the bottom of the bay for Laci Peterson's body.

"The Amber lies are easy, aren't they. Anybody in an affair lies," said legal analyst Jim Hammer. "But why does an innocent man lie to his mother about being in the Berkeley Marina?"

Peterson also talks to people about the rumor that a grocery store clerk in Washington state had seen Laci Peterson in mid-January. The rumor turned out to be false, but the experts say his reaction revealed something.

"If he really was concerned that this was Laci, he'd be on the phone all the time," said legal analyst Chuck Smith. "He'd be flying up there... He'd be doing the kinds of things a desperate husband would be doing if his wife had been located.".......

REDWOOD CITY (BCN) -- Scott Peterson may have lied to friends and family members about talking to police in Washington state after a reported sighting of his wife Laci there at the end of January 2003, according to wiretaped phone calls played at his double murder trial today.

A grocery clerk in Longview, Wash. reported seeing a pregnant woman matching Laci Peterson's description at the end of January and the national media picked up the report.

Friends and family members of Peterson began calling him about the report and he told them he had been in contact with the Longview Police Department about the report, according to wiretap excerpts played in court today.

Between Jan. 30 and approximately 9:30 a.m. on Jan. 31, Peterson told two friends and his mother Jackie Peterson he had .........

REDWOOD CITY, Calif. — Scott Peterson showed scant interest in a tip that his missing wife had been spotted in Washington, waiting almost 13 hours before calling authorities for more information and chuckling to himself when his mother suggested he fly there to follow the lead, according to phone calls played Wednesday at his capital trial.

The more than 30 calls captured by a police wire tap in the month after his wife, Laci, disappeared show Peterson deceiving his parents, mother-in-law, mistress and friends about his whereabouts and activities.

In conversations about the tip in Longview, Wash., for example, he repeatedly and falsely told his parents, friends and mistress he was in constant contact with authorities investigating the sighting.

"I just talked to the Longview police again and they're still they said they have 50 hours of [surveillance] tape to look at," Peterson told his mother, Jackie, the day after he learned of the details of the sighting from a reporter.

Investigator: Frey once a suspect

REDWOOD CITY -- An investigator suspected as late as last week that Amber Frey, a key prosecution witness in Scott Peterson's murder trial, might not have been forthcoming with authorities, he testified Wednesday.

But Steve Jacobson, the Stanislaus County district attorney's office investigator in charge of wiretaps on Peterson's phones, said officials had erred in their suspicion of Peterson's former girlfriend.

"Law enforcement was mistaken," Jacobson testified when questioned by Peterson's attorney. "We were operating under a not-valid concern."

His admission bolstered the defense argument that police conducted a flawed investigation and distracted from what one legal analyst called "damning" wiretap evidence.

In calls played Wednesday, Peterson repeatedly lied to his parents, mother-in-law and friends in the weeks after his pregnant wife, Laci, disappeared.

"The bottom line is the entire Modesto Police Department didn't figure out until a week ago that their suspicions of Frey were misplaced," former San Francisco prosecutor James Hammer said. "It's embarrassing. Is it devastating? No. But it makes ......

Hi runningbear!

Don't you just love it? If the police investigated Scott relentlessly, they are accused of "rushing to judgment" and "focusing on only one suspect, to the detriment of investigating others."

But if we then find out that they were also suspecting/investigating Amber too, somehow that is also bad for them.

Damned if they do, damned if they don't.

It's laughable. All these IDIOTS on TV are just trying to keep our outrage going at their ridiculous apologism, so we'll keep tuned in.

I think one of the problems we're seeing with the t.h.s right now is that some stations--Fox, for one--are really over-covering this. They have a segment or so once an hour, and so it's hard to come up with fresh commentary. Result--inane commentary at times. Of course, some of the ths don't even bother to come up with something original, hence the now cliche comments about cads, etc.

I'm not a media expert, but I wonder if they cut back the "commentary" portions to just two or three times a day might give us something more worthwhile. Sure, mention the news (if any), but get rid of the ths for most of the day. Please.

Yes, some FACT reporting might be nice! That's why I always stop and listen when I see Beth Karas come on.

I know, it's so boring hearing the same old excuses and bullsh** from these paid commentators. Many of them aren't up on the facts, either. Ted Williams, to this day, still mixes up Laci and Amber--or sometimes he says Lori instead of Laci.

Morning RB thanks for the pings...yesterdays tapes showed Scott lying and deeeiving his parents as well as Lacis as they think he is part of the search effort but he is just riding around in the truck and talking to Amber as he laughs at the search efforts of those 88 divers plus the thousands looking for her on land.

No need to check out the sighting in Washington as he chuckles to himslef, he knows where she is. It appears he is almost against their efforts to find her in his own private world as his comments are overheard playing back his messages. He whistles when playing back Sharon's message as she tells him that was a boat anchor they found in the bay. Instead of a comment to himself like Thank God it wasnt her, he whistles as if that was a close one as the Jury takes it all in. Can't attribute this type of behavior to a bf - gf situation anymore, this says it all.

Williams should be "axed" if he could please remove the marbles from his mouth before he speaks.
I can't imagine anyone hiring that dufuss to represent them in court. His everyday appearances on Fox indicate to me he has a pretty light caseload in his practice. :)

Jim Hammer and various other TH's were stating last night that yesterday was a bombshell day for the Prosecution.
Lying to Amber could be excused away by the Defense...but lying to family and friends???
I think a few Peterson's may have pooped their pants yesterday.

This statement seems strange to me. What would have made him think there was "NO WAY ONE PERSON COULD HAVE DONE THAT TO LACI."

Weren't the wire taps before Laci and Conners bodies washed ashore? If so, what made Steven Jacobson say "COULD HAVE DONE THAT" in order to get the warrents for wire taps? As far as anyone knew at that time, Laci was just missing.

I want to know what the "THAT WAS". Could there be lots more blood evidence in the home we don't know about yet?

Oh I agree! Beth Karas has the info from inside the court room.

Ted Williams is an idiot, IMO. I absolutely hate the way he says aksed and he acts like everyone is deaf - he almost yells out his words.

Seeing all these images of Scaught and family on tube with Scaught in a suit sitting at the defendant's table with gearloose, ma and pa in the background, prompted a visual that would be nice to see. Also, the tapes from yesterday with Scaught lying to ma create an image in the ol' gourd.

When Scaught was being held in the Stanislaus County jail, his uniform of the day was a RED jumpsuit. The RED suit denotes an accused or convicted murderer. Don't know if the prisoners in Redwood City wear color-coded jumpsuits, but the business suits he wears in court are worn only while in court. Another item from Stan. Cty jail, a prisoner is only allowed two visits from family and friends per week.

Missing from the media's video presentations are any visits the Peterson clan may be making to the Redwood City jail in the evenings to visit the perp.

But, picture this in your mind - ma and pa's first visit to the jail after the tape from yesterday. "oh, that's ok, son. You can lie to me any time you want. You're such a good boy. Any mother would overlook any of your little white lies."
