I think Kerry will sue to make himself look innocent. By the time the case goes to trial, the election will be over and Kerry can drop the suit.

He won't sue. Discovery can start the minute a judge accepts the case. ALL of Kerry's records will be up for grabs.

Kerry wouldn't sue to save his life!! The minute he sues, ALL of his records are available via subpoena and discovery!!!

Even if he lost the presidency, getting access to all of those records that he refuses to sign the release for would be the end of ANY political aspirations. KERRY KNOWS IT!!!

Let me assure you, O'Neill is FAR more shrewd than anyone may think!!!

I am not a lawyer, but if Kerry sues, O'Neill will immediately file a counter suit. If Kerry wins the election, he will be faced with a Clinton-like problem of a civil suit hanging over him, in which he could be compelled to testify under oath and produce documents. If Kerry initiates the litigation, my guess is that it would make it more difficult for a judge to allow him to delay judgment day.

There is no way that Kerry can afford to take a chance on any civil litigation involving O'Neill, particularly when he has no chance of prevailing.

Even if a handful of Swiftvets had signed false affidavits, Kerry would have to prove by a preponderance of evidence that O'Neill knew that some of the claims were false. O'Neill has been very careful to require the Swiftvets to sign sworn affidavits before he published their statements in his book.

O'Neill knew what a litigious, lying weasel Kerry is when he decided to expose him as such.

I also think Kerry will sue....if the charges are left unanswered, everyone will assume they are true.

I think the damage has been done though...the five million Vietnam vets in the country are rethinking their votes.

Kerry will avoid the lawsuit as it is just an empty threat. If he sues, he might need to sign form 180 and we wouldn't want that now would we?

If he sues they can go into discovery right away, and subpoena his records as evidence in the case.

Then, they can be 'leaked' I suppose...

Sue? Not a chance. The SBV's have to quit advertising after Sept. 2, IIRC, but a lawsuit would keep this in front of the news for the foreseeable future. Kerry is trapped.

Doubtful. If that was an effective strategy, they'd have
done it without O'Neil suggesting it.

When they filed the FEC complaint, my very first thought was:
Ah, they DON'T have grounds for a libel action.
Case closed.

Kerry CAN'T sue. If he files suit, then everything will have to come out in the open. O'Neil can start the discovery process and Kerry can be forced to sign a release of ALL of his medical records and ALL of his military records, and any FBI Files and any CIA files.

O'Neill knows Kerry would never sue for two reasons. One, the truth will come out and Two, the truth will come out. Kerry knows it too.
