Also, under New York Times versus Sullivan, Kerry would have to prove "actual malice," which is very, very tough to prove. O'Neill is smart to issue the challenge--no way in hell Kerry can sue O'Neill.

Exactly. It calls Kerry's bluff and compels Kerry, not O'Neil, put up or shut up. John Kery has built his life on less than the truth. To shine the light of compelled scrutiny on Kerrys actual life, will only confirm the validity of the title of; "Unfit for Command".

EXACTLY and Kerry (being a lawyer) Knows this

He can't have those Records and Journals released

His political career would be over .. and he knows it

I get nervous every time my fellow Freepers mention Kerry's records. Being in the military, I know that Kerry's records may or may not be accurate. It is a pretty regular thing to have your service record have some mistakes in it. Also, award citations are particularly known, especially in the navy, to be sometimes full of baloney, to put it delicately. It is not unusual to get commended for something that your buddy did, or vice versa. You just look at each other and shrug at the awards ceremony.

The reason I said all that is, I'm thinking that Kerry is holding his service record to be some kind of October surprise, where he can whip it out and say, "See, it's all here" (even though it may very well be a bunch of BS that's in there)

Thats a big affirmative! Kerry's lawyers can threaten to huff and puff but that is as far as they dare go.
