I don't think so. They, PD were investigating. Scott wasn't under arrest so, I don't think Miranda Rights were needed until they arrested him April 2003. Besides, Modesto Judge gave the okay for wiretaps. (just my opinion)

I remember some years back, that if you taped a conversation with someone one the phone, you were required to "tell" them. Not sure if that was or is a law or what.

I also remember that when anyone recorded me, there would be a beep on and off. I guess technology has come a long way. :)

A lot probably depends on state law. In NY I know it's like that, you need to tell the other party you're taping the conversation. Private Investigators though are given a little more leeway when it comes to that sort of thing.

The law varies from stat to state.
I had some trouble with phone harassment some years ago.
My attorney told me to hook up a recorder, but I was required to announce the date and that the call was being recorded in order for it to be admissible.
