Isn't that grounds for a lawsuit? More than that, it's grounds for some GREAT publicity. Michael Moore would do it, and get days of press and promotion for his bilge-- why can't our side learn to exploit these things correctly? Or does the media just not want to play along with it if it's against their bias?

Speaking as an author, you bet it is. The title is always copyrighted (when possible), and most major pubiishers copyright the jacket design, too, esp. when they have a hot property on their hands.
This is also a criminal matter; B&N are willfully mislabeling a product, with intent to deceive, a crime in every jurisdiction with which I'm familiar. And, there are UCC violations here in addition.
Question: will anyone bother going after these jerks? No idea.
