Judge faces a fight for job
The Everett Herald ^ | July 27, 2004 | Jim Haley

Judicial races aren't usually exciting, but this year's judicial contests in Snohomish County Superior Court could be more interesting than most.

At least one sitting judge, whose courtroom a lot of lawyers shy away from, is expected to face a challenge. .....

One of the reasons Lucas said he will file against Hulbert is that the jurist has been rejected, mainly by the defense bar, far more than any other judge....

Bill Jaquette, who heads the Snohomish County Public Defender office, said he files an affidavit "if I think I could do better in a different court. I think what we're saying is, with respect to a particular quality we're looking for, we would do better with another judge."...

Hulbert admits he's likely to give tougher sentences to defendants convicted of sex crimes. He considers that a badge of honor.

I tried to put the highlights in instead of just the set up paragraph, but the Herald is a excerpt only.

It seems this guy gives out tougher sentences than everyone else

I know the retired Judge they mention and they have done articles on him about his "fairness" to defendents.

I also had a co-worker who went before that judge before he retired, his brother went before him many times as well, and they laughed at how this judge was so soft on them.

He said he'd gone before the judge 8 or 9 times and give him a sob story everytime and act sorry and the judge would just give him a small fine or other such piddly punishment.

Now the Judge being challenged is obviously way more hard on the defendents because if he was just a terrible judge they would be filing not affidavits of prejudice, which mean nothing, but complaints with the bar.

I would like to see strong sentencing recommendations and then require a judge who wants to stray from the guidelines to offer a written opinion explaining why. Variance from the recommended sentence would be subject to appeal and a judge who was consistently over ruled should be retired while a judge whose decisions are consistently upheld should be promoted to an appeals court. Wide variations in sentencing don't aid justice while in limited circumstances mandatory sentences are not just.
