While her previous sexual history will not be admitted, the judge has just ruled that any post-KB-sexual activity WILL be admitted.
She had sex with three men in a 72 hour period.
If she had sex AFTER her encounter with Kobe, no jury in the world will believe she was traumatized by rape, much less injured, as she has claimed.
I'm just sittin' here in my lawn chair with a bowl of popcorn-- watchin' all the fun.
He hasn't dropped the case yet. Don't be surprised if he does.
So you are saying a person who was raped and is bi-polar might not try to find comfort with other sex partners? Perhaps she was trying to get the thought of the rape out of her mind by having sex with people who cared for her.
Here is the bottom line a rich athlete can do whatever he wants and then can hire the best attorneys to make his problems go away and just like Bill Clinton people will line up to kiss his ass.
"If she had sex AFTER her encounter with Kobe, no jury in the world will believe she was traumatized by rape, much less injured, as she has claimed."
Well as a juror you wouldn't. As a juror I would. I wouldn't want to bet my life on such predictions...
Find comfort? Is rape traumatic, or not?
If it is (as most rape victims attest), the last thing they want to do is have sex so soon afterwards.
If she wants to introduce the fact that she's bi-polar, she will have to do that on her own, as it can't be brought in.
But, one of the side effects of severe manic depression is a sexual obession when in the manic phase.
That will allow the defense to get into some things she may not want to talk about.

No. The bottom line is that a woman cannot engage in consensual sex, then call it rape later, and get away with it.
So, your definition of an idiot is one who refuses to accept your opinion that being accused is synomonous with quilty ? I don't see anyone defending Kobe much less proclaiming to be a "Kobe lover".
Neither of us would be chosen. You believe he's guilty; I believe he's not.
The defense will likely call expert witnesses who will testify that having sex so soon after a traumatic rape is almost unheard of.
And the prosecutor will likely call a expert witness that she found comfort in sex and was telling the truth about Kobe raping her.
Nice use of the Bill Clinton card, the conservative equivalent of the liberal's Nazi card, but completely irrelevant here. The "Bottom Line" as you put it is that in a criminal trial for rape under the American "innocent until proven guilty/reasonable doubt" system, if all of the physical evidence can be thrown into doubt, it boils down to a he said-she said case, and that's more than reasonable doubt, especially given other behavior of the alleged victim.
Let's recap:
1)No semen evidence from Kobe, but from others.
2)Slight physical injuries, but since she's apparently had sex with others between incident and examination, they can't be linked to Kobe
3)Odd behavior of victim after alleged incident. You can try to spin it anyway you want. "She was so traumatized by the rape she just wanted to have sex with two other guys before going to the cops" but it still seems odd.
4)Alleged victim's odd behavior before incident, separating Kobe from his bodyguards, then sneaking up to his room
"The bottom line is that a woman cannot engage in consensual sex, then call it rape later, and get away with it."
Well it will be certainly interesting to see what the jury believes...
Do you believe OJ is innocent because a jury found him to be?
More importantly, sworn testimony on behalf of the witness. Last I heard in a court of law, sworn testimony was still considered evidence.
Except that, statistically, that expert witness would be wrong. Women who are raped do not immediately seek out sexual relations for comfort, especially if they suffer vaginal injuries, as this accuser maintains.
I don't claim to know what argument or even present an expert witness will be presented on behalf of the witness.
I would tend to be willing to believe her if she steps up on the stand to say he did, and he doesn't.
No. The evidence against him was overwhelming.
In this case, there is nothing but her word against Kobe Bryant, and plenty of evidence that the sex between them may have been consensual up until she got scared and told him to stop, which he did.
All it takes is reasonable doubt, and there is boatloads of that.
Sworn testimony by who? The victim? Kobe will equally swear that it was consensual. It returns to he said-she said. It's still reasonable doubt, unless you've got a very strict definition of reasonable.
I would still like to believe in a system where just telling the truth is enough.
He does not have to testify, remember. But he likely will.
She has to testify, or the DA has no case. She will not have an easy time of it, on cross-examination.
Women never falsely accuse men of rape?
"Kobe will equally swear that it was consensual."
He'll have to find a way to be convicing to saying that when at first he lied that he did it all to the police.
