It looks like few articles (no mention on FOX either) are including that Berger PUT DOCUMENTS DOWN HIS PANTS!

They allow it to sound like he accidentally gathered up these papers along with his own. Which is the point, of course.

Quite right, Mr Berger's notes were "classified, not stamped" documents, (or he wrote in code which will still get him busted). He is in violation of the espionage act, and he doubtless signed a statement to the effect that he understands this act. He will never rat his friends in higher places, but he should do time.
