AP: Clinton Adviser Probed in Terror Memos

WASHINGTON - President Clinton (news - web sites)'s national security adviser, Sandy Berger, is the focus of a criminal investigation after admitting he removed highly classified terrorism documents from a secure reading room during preparations for the Sept. 11 commission hearings, The Associated Press has learned.
Berger's home and office were searched earlier this year by FBI (news - web sites) agents armed with warrants. Some drafts of a sensitive after-action report on the Clinton administration's handling of al-Qaida terror threats during the December 1999 millennium celebration are still missing.
Berger and his lawyer said Monday night he knowingly removed handwritten notes he had taken from classified anti-terror documents he reviewed at the National Archives by sticking them in his jacket and pants. He also inadvertently took copies of actual classified documents in a leather portfolio, they said.
"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," Berger said in a statement to the AP.
Berger served as Clinton's national security adviser for all of the president's second term and most recently has been informally advising Democratic presidential candidate John Kerry (news - web sites). Clinton asked Berger last year to review and select the administration documents that would be turned over to the commission.
The FBI searched Berger's home and office with warrants earlier this year after employees of the National Archives told agents they believed they witnessed Berger put documents into his clothing while reviewing sensitive Clinton administration papers, officials said.
When asked, Berger said he returned some of the classified documents, which he found in his office, and all of the handwritten notes he had taken from the secure room, but said he could not locate two or three copies of the highly classified millennium terror report.

Mills' tenure, however, was not without controversy. Republicans on a House subcommittee accused her last year of withholding two documents from investigators on an unrelated matter. She denied withholding the documents.
And on the eve of her questioning by Senate Whitewater Committee staff a few years earlier, Mills' car was broken into and copies of notes stolen.
Well, then, how can they submit their report?
Reminds me of the Clinton impeachment lawyer whose name escapes me. He was disabled, and another freeper may recall his name. He died rather suddenly. Or it seemed that way to me.

After making my way through the thread, I have two points: (1) Sarbanes Oxley applies to corporate malfeasance like this; does anyone know how (or if) it applies to Berger and the documents in question? (2)Someone should file an ethics complain in whatever jurisdiction that granted this slug a law license.

OK, I'm confused by the word "taken".
The AP story says: "Berger was allowed to take handwritten notes but also knew that taking his own notes out of the secure reading room was a "technical violation of Archive procedures, but it is not all clear to us this represents a violation of the law," Breuer said."
Did he "take" as in "write" notes while in the reading room, or did he "take" as in "steal" notes that were already in the reading room? The former is not as bad as the latter. But either are nothing compared to the other "Taking" as in "stealing" of after-action memos, which he can't find now. Must be with Hillary's Rose Law Firm billing records.

I'm not any better off. Mine are Clinton and Schumer.
Maybe after Berger stole the documents the Administration restricted who could get in to view the documents, and restricted which documents people could see.

Ah, there's the rub. Since this appears to have been a sting, there's no way to know who's involved. And the call to Lindsey makes me think that his corrupt ass has also been nailed to the wall.

This is criminal. National security violation. Law license is toast if convicted.
