Probably a criminal. Ken Lay, Martha Stewart, Micheal Jackson, Saddam Hussein.... They may be indeed guilty, but neither Ken Lay nor Michael Jackson have been found "guilty" in a court of law.
In the U.S., accused people are innocent until proven guilty.
