***(Thurs 7-8) ASK JAYNA DAVIS QUESTIONS ABOUT HER BOOK -- "THE THIRD TERRORIST"***

Jayna Davis, author of THE THIRD TERRORIST, is scheduled today for the Larry Elder show, guest hosted by Doug McIntyre. The time is 3pm Pacific. Then at 6pm Pacific, she will be on this thread to answer questions.

Jayna's work in exposing the Iraqi connection in the OKC bombing has been endorsed by James Woolsey, Dave Schippers, and Frank Gaffney. No, folks, McVeigh and Nichols did not act alone.

If you haven't read the book, please look over the info on the website, particularly the interview done on the Glen Beck show. You can listen to the Larry Elder show online by going to the KABC WEBSITE.

Let's try to make it easy for Jayna. Because I anticipate a busy thread with lots of comments, please use red font to ask questions.

Here's my two questions to Jayna:

1. The June 9, 2001 Salon Magazine article “The Mystery of John Doe No. 2" begins with an event in a Junction City, Kansas Subway sandwich shop. It reports that three clerks, including Joann Van Buren, witnessed McVeigh, Nichols and a third man patronize the shop together. The Salon author states, “The third was a shorter, dark-haired and muscular man with an olive complexion: a perfect fit for the figure destined to be known as John Doe 2.” The FBI confiscated the in-store video for that day.

My question: did you interview any of these Subway clerks, what do you think of their stories, and has the FBI ever affirmed the video’s existence, perhaps by releasing it to the defense lawyers?

2. During the latest Nichols trial a document was produced often called the “Secret Service Memo”. It stated in part:

“A witness to the explosion named Grossman claimed to have seen a pale yellow Mercury car with a Ryder truck behind it pulling up to the Federal Building. Mr. Grossman further claimed to have seen a woman on the corner waving to the truck. ATSAIC McNally noted that this fact is significant due to the fact that the security video shows the Ryder truck pulling up to the Federal Building and then pausing (7-10 seconds) before resuming into a slot in front of the building. It is speculated that the woman was signalling the truck when a slot became available”

As I understand it this passage contradicts the government’s claim there was no videotape of the explosion site, and contradicts that only one driver was involved, ie, in this scenario at least one was driving the Ryder truck, another driving McVeigh’s Mercury get-away car.

My question: I would like your general thoughts about the importance of the memo, the government’s explanation why it should be disregarded, and why was it only produced at the time of Nichols’ second trial.

QUESTION: Jayna, why is the current Justice Department not following up on your information?

Let's examine the history of the Justice Department toward my investigation first.

FBI RESPONSE

On the federal level, the Department of Justice flatly rebuffed my attempts to surrender the evidence. My encounters with the FBI began in the spring and summer of 1995.

KFOR management and I initially discussed our findings with federal agents as we discovered new evidence of Middle Eastern participation. But their zest for our information evaporated when the third terrorist, John Doe 2, inexplicably vanished from the Bureau’s radar screen.

In the fall of 1997, upon the advice of my lawyer, I set an appointment with an FBI agent to surrender all twenty-two witness statements and hundreds of pages of supporting information which implicated Middle Eastern suspects in the bombing plot.

When I arrived at the Oklahoma City field office, accompanied by a notary public, I requested the FBI sign a receipt acknowledging the Bureau took possession of the evidence. That is when the FBI blatantly refused to take receipt of the investigative file.

When I demanded an explanation for such absurdity, one of the lead prosecutors for Terry Nichols’ federal trial told my attorney that the DOJ did not want any more “documents for discovery” to turn over to the defense teams.

When my attorney Tim McCoy requested a written statement confirming their conversation, the prosecutor refused to give him his personal fax number unless he promised to delete all references to the “Oklahoma City bombing” and my attempts to turn over “witness statements.”

The resulting statement was simply ludicrous.

It read, “The Department of Justice has not made any investigative demands for any knowledge Jayna Davis may or may not have.”

I was dumbfounded. The federal government’s capital investment in resources and manpower to track down the killers was historically unparalleled.

But the FBI slammed the door on a reporter from the mainstream media who attempted to share credible evidence which needed to be seriously examined.

In 1999, I returned to FBI headquarters in Oklahoma City.

Dan Vogel, a courageous FBI agent, agreed to take custody of the twenty-two witness affidavits.

Despite Agent Vogel’s obvious concern that the Bureau speak to the witnesses, there was no legitimate attempt to prove or disprove the evidence.

The FBI did not contact any of the witnesses and failed to interview Hussain Alhussaini.

Terry Nichols Preliminary hearings

Two years later, in October 2001, Agent Vogel was subpoenaed to testify in Terry Nichols’ preliminary hearing in the Oklahoma state bombing trial.

Nichols’ lawyers told the judge that Agent Vogel confirmed he received twenty-two affidavits from reporter Jayna Davis, but after he turned them over to the FBI legal department in Oklahoma City, the sworn statements disappeared.

Government prosecutors barred the agent from taking the stand so he was denied the opportunity to personally deliver his testimony.

In March of 2001, Terry Nichols’ defense lawyers subpoenaed me to testify in a pretrial hearing regarding the actions of the FBI in response to this investigation.

By virtue of being called as a witness, I was able to confirm the FBI statements of several of my witnesses were never recorded, contained inaccurate or patently false information, or were withheld from the defense teams. Three of my attorneys, my husband notary Pam Nance, and one of my witnesses, Rachel Sealy, took the stand to corroborate my testimony.

Missing Evidence

In the summer of 2001, the FBI discovered it had inadvertently withheld 4400 discovery documents from the defense teams.

The bureaucratic snafu postponed the execution of Timothy McVeigh

When the evidence was finally remitted to the defendant’s lawyers – the affidavits that I remitted to Agent Dan Vogel in 1999 were still missing.

That said, here's my educated guess as to why the current DOJ is not looking into the evidence outlined in The Third Terrorist: The Clinton DOJ blantantly refused to investigate evidence which would have mitigated the roles of both McVeigh and Nichols - that refusal might have constituted a felonious act of obstructing justice. To revisit such an issue now would mean a criminal investigation and that is a political hot potato no one wants to handle, or so I've been told by sources inside the Beltway.

Dear Jayna,

I am in Australia and haven't seen your book yet; and also missed your radio appearance just now. There are two issues I want to bring up.

1. Have you noticed that the Waco siege began two days after the first World Trade Center bombing? And it ended just after former president Bush returned from the trip to Kuwait which ultimately provided the pretext for retaliation against Iraq later in the year.

Also note: exactly two years from Kuwait's liberation to the WTC bombing; exactly two years from Waco to Oklahoma City. It's as if McVeigh was saying, I won't let you spin it away this time.

2. What is the evidence for an Iranian or Syrian connection? Maybe Iraq and Iran are in it together, stranger things have happened; but I see ample evidence linking the attacks on the American homeland to Iraq, and next to nothing connecting them with Iran.

Yet there are people who are determined to portray Iran as the mastermind. I read at your website that you went on radio with Patrick Lang and Larry Johnson. They were in the media more recently, during the Chalabi affair, suggesting that the war in Iraq was a mistake and the result of Iranian disinformation. Yossef Bodansky, of the famous Congressional Task Force, wrote a whole book on the 1993 bombing blaming it on Iran, and indeed on a slew of other countries (Syria, Sudan, Pakistan) - but not Iraq; and he somehow fails to mention that it took place on the second anniversary of Iraq's defeat!

So what's going on here? Do people seriously think Iran, not Iraq, is the real enemy? Or is it just another cover story?

P.S. I also have a problem with Laurie Mylroie's 'stolen identity' theory. I think it's much simpler to suppose that Ramzi Yousef is both Abdul Basit Karim and an Iraqi asset. That would actually explain the irregularities in his Kuwaiti file just as well; and Laurie has nothing to say about the fact that Abdul Basit's other uncle, Zahid Sheikh Mohammed, was Kuwait's version of Osama bin Laden, back in the 1980s. But that complaint belongs in another thread.

QUESTION: Jayna, what can the FReepers do to help advance the story? Who are the friendly ears in the Justice Department or Congress?

I believe the most effective response from the legendary Freepers is to get organized and formulate a two-prong strategy. First, call your local radio shows and get me booked as a guest to spread the message. Secondly, choose favorable Congressmen and Senators who have the moral fortitude to follow through. Specter and Burton are out of the mix. (Chapters 11 and 20 for details.) Next, phone and e-mail the DOJ and Ashcroft's office demanding that the Middle Eastern suspects identified in The Third Terrorist be detained and interrogated. If the DOJ is going to release the man nailed by a plethora of witnesses as JD2, then the Bureau must be prepared to give him a government-issued alibi --- because he doesn't have one. I say that his whereabouts for the critical hours of April 19 cannot be established and the evidence I have compiled proves that fact beyond a reasonable doubt! ( see chapters 10 and 15)

More importantly, this man should be questioned because he might have peripheral knowledge of the next strike that Al-Qaeda is prepared to launch. He obviously knew something about the events of 9-11 as far back as 1997 when he was working at the Boston Logan International Aiport (Chapter 21 of my book). He might be in the loop regarding the next operation set to occur prior to the fall elections.

Remember, American intelligence authorities have to be accurate 100% of the time, but the terrorist only have to be success 1% of the time. We NEED ALL THE INFO WE CAN GET. THIS MAN SHOULD BE INTERROGATED!
