Schwarzenegger ad lawsuit a case for Ohio, court rules - Auto dealer lacked OK to use image

If Gov. Arnold Schwarzenegger wants to sue an Ohio car dealer who ran a local newspaper ad with a photo of the Terminator, he'll have to do it in Ohio, a federal appeals court said Wednesday.

The film star and future governor filed a suit in Los Angeles in 2002, seeking up to $20 million in damages from Fred Martin Motor Co. and an advertising agency. The ad, which ran in the Akron Beacon Journal for five days in April that year, showed cars for sale and included a small picture of the actor in his most famous role, with the words "Arnold says: Terminate EARLY at Fred Martin!'' urging customers to end their current leases and get a new car.

Schwarzenegger, who was never asked for permission to use the photo, said in his suit that the ad "diminishes his hard-earned reputation as a major motion picture star'' by potentially overexposing his likeness to the public. For that reason, he said, he has never endorsed a product in the United States.

The suit is one of many Schwarzenegger has filed to protect his image and reputation.

It's not a matter of money for him. He doesn't want people misusing his image--for commercial purposes, or anything else. He has a right to protect his image. Anyone who would illegally use his image (cheating) would probably cheat customers. Does he want his face associated with that kind of scum? He's worked a long time to build his image.

If the punishment isn't severe, others might be tempted to follow the dealer because they'll think the risk is worth it.

Oh, I hope it is for CA's sake as well. Because I believe Governor MakeBelieve believes we'll have another Dot.Commonist boom which is the only believable thing that could ever pick up the tab for all his "back-loaded" to the hilt make believe deals!
