REDWOOD CITY -- A ribald conversation between Scott Peterson and a woman he had just met at a trade show was so inappropriate it made one of Peterson's employees uneasy, according to the employee's testimony Tuesday in Peterson's double-murder trial. "Scott and (the woman) had a conversation that I believe was somewhat inappropriate for a married man and an engaged woman. There were discussions about sexual positions and what she liked and what he liked," said Eric Olsen, a fertilizer salesman hired by Peterson. Olsen said the steamy conversation occurred at a trade show the two men were attending at the Disneyland Hotel in October 2002. Prosecutors wanted the jury to hear the conversation, because the woman involved was Shawn Sibley, who introduced Peterson to Amber Frey shortly thereafter. Olsen's testimony marked the beginning of the prosecution's groundwork for their star witness, Frey, whom they believe inspired Peterson to murder his pregnant wife. More than a month after the dinner conversation, Sibley called Olsen with a serious question. "She wanted to know if Scott was married. At that point, as an employee of Scott's, I didn't want to be plugged into the situation going on," Olsen said. Shawn stated she wanted to set up Scott with one of her friends. The judge in the capital murder trial of Scott Peterson paved another avenue to appeal yesterday by allowing a police officer to testify about an anonymous tip, a legal expert said.

``This alleged conversation between the defendant and an anonymous caller is clearly inadmissible as evidence,'' said J. Albert Johnson, a defense attorney and former prosecutor.

Johnson was referring to Judge Alfred A. Delucchi's decision to allow Detective Allen Brocchini to testify about a man who claimed that Peterson had told him nine years earlier that if he ever killed someone, he would dump the weighted-down corpse in the ocean and let the fish eat it. .......

On Wednesday, June 23, the judge in the Scott Peterson criminal trial removed one of the jurors, Justin Falconer, and called on an alternate to replace him. After Falconer was dismissed, the defense then moved for a mistrial, but its motion was denied.

In this column, I will argue that Falconer should not have been dismissed in the first place. Although Falconer slipped up in making what turned out to be an innocuous comment to a Peterson relative, the comment itself did not indicate bias on his part, and should have been forgivable under the circumstances. .......

2:14 p.m.: REDWOOD CITY -- Stanislaus County Deputy District Attorney Rick Distaso Tuesday morning showed the jury in Scott Peterson’s double-murder trial that it is easy to leave a mistaken impression.

He asked Modesto Police Detective Al Brocchini about a tip he received from one of Peterson’s college buddies, who said the defendant in 1995 described how he would dispose of a body.

“He said he would tie a bag around the neck with duct tape, put weights on the hands and throw it into the sea,” Brocchini said, recalling the phone conversation.........

Brocchini also cast doubt on the efforts of Peterson and his family to search for his wife. His parents and siblings established a separate tip line after becoming frustrated with the direction of the police investigation. Peterson, however, promised to turn over tips from the line to investigators.

But Brocchini tested the pledge by calling in a real tip Modesto police had received. That tipster said Peterson was spotted driving his truck and boat in the direction of the marina at 3 a.m. Dec. 24. According to the tipster, there was a bundle in the boat. Brocchini posed as the tipster, but no one from the Peterson camp ever called to follow up, nor did they pass on the information to police.

Couldn't have said it better myself RG!! Excellent and TRUE. It's not one action, it's the compliation of actions that very easily translates into guilt. These Defense Lawyer types are P'sOS themselves imo. They are excusers of the unexcusable!! Laci and Connor deserve better than that. A divorce would have been sufficient if Mr. Peterson hadn't been so greedy. Laci, I have no doubt, would have gotten along just fine.

Precisely the words just used by O'Reilly. Female attny (name?) said there will be guns blazing by Geragos next week over Brocchini's bombshell testimony yesterday. She wouldn't disclose what she's learned but said Brocchini's ethics will be on trial and expect to see something similar to 'A PLANTED GLOVE', ala OJ Simpson. Obviously she's heard it from the MG camp so I take it with a grain.

This is the first I've heard of witnesses who saw him in Berkeley in the middle of the night. As much as I'd like to believe it--HOw would they see him in the dark??

Now as far as the burglar seeing him doing something suspicious, that I could believe.

20 Nov 2002 The affair with Amber

Scott met Amber at the World Sports Cafe in Fresno. They spent the night at the Radisson hotel, with Scott returning to Modesto on the 21st. Smitten from the start with her new beau, parading him around her friends saying he could be "the guy," Amber allowed Scott to occasionally pick up her 2-year-old daughter from day care, and she started bringing him to family functions. Some sources report that Scott talked of marriage. Frey's friends say she is haunted by the fact she had a trusting relationship with an adulterous man facing a possible death sentence for the murder of his wife and unborn child.

20 Nov 2002 Laci watched the Bachelor with friends

Laci spent the evening at Lori Ellsworth's house watching the Bachelor with friends.

Late Nov 2002 Cory Carroll

According to Carroll, he and Scott met at the City Lights strip club in Fresno. When Scott found out Carroll had a criminal record, he asked him if he knew of someone who would steal Laci's car so Scott could fraudulently collect on the insurance. Carroll says Scott gave him his phone number. He also says that Scott paid to have his picture taken with one of the bar waitresses, Tammy, but she kept the picture. Carroll says he and Scott had several phone conversations after this first meeting.

30 Nov 2002 Laci at the Jewelers

Laci was at the jewelers examining jewelry and selecting a style for the ring she was having made by combining her wedding rings with some diamonds from her grandmother's rings. Laci told Felix that she and Scott were going to Monterey, that Scott loved ocean fishing at Monterey and also fishing in the Delta. She said Scott had worked for a law firm in Monterey. Laci also told Felix that Scott was the one who wanted the jewelry appraised, and that he would be happy to learn that it was worth at least $100K. Felix was asked about other pieces of jewelry that Laci inherited from her Grandmother. One in particular, a pendant, Felix said Laci would not leave to be cleaned because she didn't want to lose it. Felix said she were it each of the 10-12 times she saw Laci. Another piece was a blue sapphire ring, which had a missing stone. The jewelers replaced the stone and Laci wore that ring in place of her wedding ring while waiting for the redesigned ring to be completed. She also received a diamond Geneva dress watch, and a Croton watch that was also a dress watch.

2-4 Dec 2002 Scott spends time with Amber

Scott spent Monday through Wednesday with Amber and her daughter in Fresno, attending to business during the day, and staying overnight at Amber's.

10 Dec 2002 Laci sells some of her Grandmother's jewelry

Laci sold a gold chain she inherited from her Grandmother at Brooks Pawn & Jewelry in Modesto, for $140. To sell jewelry at a pawnshop, the seller must provide picture identification and take a thumbprint. The sale is recorded in triplicate, and two copies are sent to the Modesto Police Department. From Amy's testimony, it appears that Laci was sharing the proceeds of these sales with her.

11 Dec 2002 Scott attended a birthday party with Amber

Scott and Amber attended a birthday party for Shawn Sibley's fiancé, Tom. They made plans for Amber's formal Christmas party on the 14th, and Scott rented a tux at the Fashion Faire Mall in Fresno.

13 Dec 2002 Laci picks up the diamond watch from the jewelers

Laci had brought the diamond watch she inherited from her Grandmother Rocha to the jewelers to be repaired, as it was losing time. She picked it up on the 13th, and the repair cost $63. This is the watch she had on in several of the pictures shown during the trial, and which was on her dresser with her other jewelry on the night of Dec. 24. The jeweler said Laci had her fingernails painted red in preparation for the Christmas party the next night. As Laci walked away, she sensed that Felix was watching her and turned around. Felix told her she was starting to waddle. Laci was laughing. Felix told her she looked cute pregnant, and Laci said, 'yea, right.'

14 Dec 2002 Laci sells more of her Grandmother's jewelry

Laci sold a few more items of her Grandmother's jewelry--a ring, a charm, and some gold chain. She did not have her ID on her, but Scott was with her and used his ID and thumbprint. The sale price was $110. Laci told Victoria Brooks, cow-owner of Brooks Pawn & Jewely, that she was cleaning out her jewelry box and she had inherited the items from her Grandmother. Victoria testified that they follow the same process whether the items are sold to them or pawned. Brooks also testified that Laci appeared agitated with Scott because he was rubbing her belly.

Scott and Amber attended a Christmas party at the World Sports Bar in Fresno. The pictures taken at this party would become the evidence of Scott's affair and would be published in several national magazines. Scott spent the night at Amber's and they talked about a lot of things. Amber told Scott she was a single mom looking for a serious relationship, and she wanted more kids. Scott said he didn't want any children, her child was enough for him. He said he was thinking about getting a vasectomy. Amber replied that he was only 30 years old, kind of young for that. No, Scott said, I don't want any children, and your child will be enough for me.

The same night, Laci attended a Christmas party hosted by Terri Western and Stacey Boyers. She spent most of the night sitting in a rocking chair, as she was having a difficult time getting around. She was only there about an hour and a half. Laci had told Sharon Scott couldn't be there because he had to go to San Francisco to meet with someone from his company. Sharon asked if it couldn't wait until Monday, and Laci said No, that's when that person would be in San Francisco. Lori Ellsworth testified that Laci told her she was excited about the baby but very tired. Lori said she stayed inside talking to people, and sat down for awhile.

14 Dec 2002 Subpoenaed phone records

Investigators obtained phone records that indicate Amber called Scott an average of twice a day from Dec.14-23. KTVU reported that investigators obtained these phone records to determine if Amber called Scott at his home in the days just before Laci's disappearance. The first attempt to get a search warrant for the phone records appears to be Jan.22, 2003, 3 weeks after Amber began cooperating with the investigation.

15 Dec 2002 Last dinner with Laci

Scott returned from Fresno and Ron and Sharon had dinner with him and Laci at the Covena home. This was the last time Sharon saw Laci alive. Much of the conversation was about fishing, as Ron told them Sharon had gone fishing with him just that morning. Though Scott knew Ron is an avid fisherman and would love to have chatted about the boat, Scott never mentioned the boat that night. Laci does not seem upset or to know about the affair.

16 Dec 2002 Laci picked up a tennis bracelet from the jewelers

Laci had left a tennis bracelet, one of the items she inherited from her Grandmother, at the jewelers for repair, and picked it up on Dec. 16.

20 Dec 2002 Scott makes a cement anchor

In his OS, Distaso said Scott made his one cement anchor on the 20th, and that Scott said he made only one, from a 90-lb. bag of cement.



23 Dec 2002 Scott at the warehouse

8:30am Ron Prater told Detective Brocchini, on Dec. 28, that Scott was already at the warehouse by 8:30 a.m.

8:30 pm At 8:30 pm Laci called her mother. Sharon was on another call at the time, so the conversation was brief, only about a minute or so. Laci called to confirm that they would be going to Sharon's on Christmas Eve for dinner. There was no mention of Scott going fishing or of any other activity they were going to do the next day. Sharon set the time for Scott and Laci to go over at 6:00 pm. and did not think it unusual for Laci not to have mentioned Scott was going fishing. Laci told Sharon she was very tired, but didn't talk about any problems, except to mention that she hadn't purchased Christmas gifts for all of Sharon's guests. No definitive explanation has been given for why Laci waited so long before accepting Sharon's dinner invitation. Suggestions were made by the Defense that it was because Laci was having a personal conflict with one of Sharon's guests. The only guests identified by Sharon, other than Scott and Laci, were Ron's mother and sister. Brent and his family were not attending, and neither was Amy.

Christmas Eve Truck driver saw Scott

3:30 am A truck driver named Dave says he saw Scott Peterson driving on a highway close to the marina area. "He was interested because he was thinking of buying a boat himself. He pulled up alongside, close enough to check the maker's name on the boat - Gamefisher." Dave told a co-worker, Marietta Wallace, that he saw a large bundle wrapped in a blue blanket, like a Mexican-motif-type blanket, in the back of the boat. Wallace reported this information to the police hotline on 9 Jan 2003.

Christmas Eve Police Theory: 2 Marina trips

The police believe that Peterson made two trips to the Berkeley Marina on Christmas Eve -- one early morning journey to dispose of Laci's body and another later in the day (his "fishing" trip) to create an alibi.


Christmas Eve Scott's cell phone call

10:08 am Scott made a call on his cell phone that was transmitted by the cell tower at 1250 Brighton Avenue, which services the area of 523 Covena (Scott and Laci's home). The call lasted 1 minute 21 seconds, and was a call to its own voicemail. While the call was in process, the transmission was switched to the cell tower at Tenth and D, at the water tower near downtown Modesto. A police officer later timed a drive from the Covena home to the border of the Brighton tower radius, and it took exactly 1 minutes 21 seconds.

Christmas Eve Scott logged on to his work computer

10:08-11:00 am According to questions posed by Geragos to Investigator Steven Jacobson at the Preliminary Hearing, information from Scott's hard drive (not actually discussed at the Prelimin indicates Scott used his computer from shortly after 10:08 a.m. until almost 11:00 a.m.

Servas determined the exact time she found McKenzie by retracing her steps from the time of a purchase she made at Austin's at 10:34 a.m. and a cell phone call at 10:37 a.m. She arrived home from her errands between 11:45 and 12 Noon. Servas also testified that she had never seen McKenzie running loose with his leash on, and had never seen Laci walking McKenzie alone. She had seen Scott and Laci walking McKenzie together, maybe once or twice.
