Judge tells Peterson jury to keep quiet

REDWOOD CITY -- The judge in the Scott Peterson double-murder trial Monday warned all of the trial participants not to talk about the case to the media.

Judge Alfred Delucchi was responding to stories that surfaced at the end of last week, when a representative of the Modesto Police Department publicly defended Detective Al Brocchini, who has been the subject of harsh criticism by Peterson's lawyer Mark Geragos during his time on the witness stand.

"This has to stop. Go tell the chief he's going to have to sit on his people," Delucchi told a Modesto police captain. .........

Lead defense attorney Mark Geragos continued his quest to show that Modesto police zeroed in on his client, Scott Peterson, while ignoring other credible leads that poured in after 27-year-old Laci Peterson was reported missing.

First Geragos pointed to Kim McGregor, a neighbor who admitted to police that she stole a video camera, several jackets and Laci Peterson's Social Security card from the Petersons' Covena Avenue home.

He also suggested that Amber Frey, Scott Peterson's former girlfriend, held back some taped phone calls from authorities after agreeing to secretly record her conversations with Scott.

The suggestions came during a wide-ranging cross-examination of Detective Al Brocchini, who took the witness stand for a fourth day.

REDWOOD CITY -- Kim McGregor appeared to be infatuated with Scott Peterson, and she robbed his home after his wife disappeared.

Monday, Peterson's defense team pointed to the Peterson neighbor as an indication that police ignored other suspects in the missing-person case that turned into a double homicide.

Lead attorney Mark Geragos also suggested that Peterson's former girlfriend, Amber Frey -- after she agreed to secretly record her conversations with Peterson -- did not reveal some of the calls.

The questioning about McGregor and Frey came as Geragos cross-examined Modesto police Detective Al Brocchini for a third day. The defense scored a blow toward the end of last week when Brocchini admitted that he "excised" a key piece of information from a police report.

Sgt. Ed Steele came to Brocchini's defense Friday in an interview with The Associated Press, violating a gag order in the case. This led to a warning -- but no sanctions -- from Superior Court Judge Alfred Delucchi to the Police Department.

Delucchi reminded all of the participants that the order issued by Stanislaus County Judge Al Girolami before the trial began forbids not only the attorneys and police from commenting on the case but also any witnesses who have been subpoenaed, including family members of either Scott or Laci Peterson. The judge said that while he did not want to be a "policeman," he would not hesitate to use his authority to prevent anyone involved in the trial from talking to the media.

He doesn't have grounds for a mistrial, b/c it's HIS fault that that type of questioning was pursued!

But suppose he DID have grounds for a mistrial. There's another thing to be considered when asking for one: he has to think to himself, what if the judge were to grant it? If I feel like my side is winning, should I ask for a mistrial, putting an end to my winning trial, when I just might GET a mistrial?

And I'm sure Geragos feels like he's winning. He's that type of guy.

Yea, I though he was creepy when he began with Trade Corp. But, good fertilizer salesman are hard to come by and I thought well let's give him a chance. Well it worked out for a while and well 'you know' I tried to overlook his persistant sexual overtures and thought he was just lonely because he said he never had a girl friend. So I fixed him up with my friend Amber. You know she thought he was just perfect until.... Now, in hindsight I realize that I should have followed by original instincts about him = he's a creep.

Took a drive by the Covena Avenue site tonight to check on a detail I heard about several months ago. Two vehicles parked in the driveway.

Now the detail... Seems the phone company installed several phone boxes for the media while they camped out in the early days of Laci's disappearance.

Also installed at that time for MPD was a line for hooking up a video camera for surveillance of the house. The info I heard back then was that the camera was mounted on the pole directly across the street from the house. Wondering now if the guys at the cop shop got any pertinent info from the surveillance camera and if so, if it will be introduced at the trial.

Yes, I think they did get something usable from that camera. I think the camera enabled them to see when Scott was leaving his home, so they could follow him. Seems like that may have been what enabled them to follow him on his many odd trips to the marina.

I don't think this camera was monitored all the time. For example, I think they shut it down when they knew Scott was going to L.A. (or was it San Diego) the weekend of Jan. 18 or 19, 2003. That would be why the camera didn't record Kim McGregor breaking into the house--assuming she came up through the front yard/driveway area, that is.

Remember the next-door (Reed) house that was vacant? Didn't they also set up some sort of surveillance inside that? Now that we know that the house's owner, Greg Reed, was a friend of Scott's, makes me wonder if Scott found out about that.

Yes! IMO, that's the sort of thing she should say by way of explanation. Hope they don't all try to cut off all her answers. A witness is supposed to be allowed to explain if they want to.

I reviewed the testimony in the prelim. The remote camera was used when they wanted to put a tail on Scott...and did not want to park on the street to tip him that he was being watched...

Geragos's cross examination and pleas to the judge indicated he thought they had more tape than they had turned over but there was no evidence presented in that cross to reveal that they did.

Well stated.

They shouldn't have let Justin get away with saying that the tip about how Scott would kill someone was not true. It may or may not be true but Justin has no way of knowing this. Yet he stated at least twice that it is not the TRUTH.

From the shows I've observed, there is repeated admirations for good Geragos and how famous he is and nitpicking at the prosecution -- until yesterday. I believe it was on Greta's show that someone said Geragos goofed in bringing up the leads and now that statement about how Scott might kill someone. Shades of the dishonest Feldman.

If he did goof, it was a pretty elementary mistake.

Apparently Brocchini and the rest saw/received literally thousands of tips. One of them was this one about the friend who'd had the body disposal discussion.

Given CA's liberal discovery laws, if the State team knew about that tip, then the defense team has to have known about it too.

So, Geragos KNEW VERY WELL, when he engaged in that line of questioning to Brocchini, about how "Oh, you didn't follow up the tip about seeing Laci at the warehouse... Oh, you didn't follow up the tip about the blue van...etc."--Geragos KNEW VERY WELL that he was in danger of causing an incident like the one that just happened, where the body disposal was brought up. Trust me, he KNEW VERY WELL.

But Geragos just has to ham it up. He doesn't care what people say about him, as long as they talk about HIM. He's the narcissist here, not just Scott. A lot of those lawyers who do lots of jury trials are like that. It's a common personality in that profession. They are also given to many excesses outside their personal lives--I remember we heard a rumor about the presumably married Geragos and some woman in a hotel room, don't know if it's true, but wouldn't be surprised.

OTOH, I don't know if Geragos really DID do lots of jury trials--all I've ever seen him do till now was blabber on, on TV, about how wonderful CLINTON was, or about whatever they paid him to blabber about.

So the debris on the gun is probably not particularly significant? What I can't figure out is, does it look like the gun is going to have any role in Laci's murder or not? It sure would be nice to have a probable cause of death.

Debris in the muzzle/barrel so soon after the murder could be problematic. Unless the debris can be shown to have accumulated within a short period of time and from specific locations related to SP's travels in the previous 24 hrs. I can't figure out why the prosecution would put the gun into evidence and call gun experts unless they meant to give it some significance.
