Judge tells Peterson jury to keep quiet

REDWOOD CITY -- The judge in the Scott Peterson double-murder trial Monday warned all of the trial participants not to talk about the case to the media.

Judge Alfred Delucchi was responding to stories that surfaced at the end of last week, when a representative of the Modesto Police Department publicly defended Detective Al Brocchini, who has been the subject of harsh criticism by Peterson's lawyer Mark Geragos during his time on the witness stand.

"This has to stop. Go tell the chief he's going to have to sit on his people," Delucchi told a Modesto police captain. .........

Judge Alfred Delucchi scolded Modesto police Monday.

Lead defense attorney Mark Geragos continued his quest to show that Modesto police zeroed in on his client, Scott Peterson, while ignoring other credible leads that poured in after 27-year-old Laci Peterson was reported missing.

First Geragos pointed to Kim McGregor, a neighbor who admitted to police that she stole a video camera, several jackets and Laci Peterson's Social Security card from the Petersons' Covena Avenue home.

He also suggested that Amber Frey, Scott Peterson's former girlfriend, held back some taped phone calls from authorities after agreeing to secretly record her conversations with Scott.

The suggestions came during a wide-ranging cross-examination of Detective Al Brocchini, who took the witness stand for a fourth day.

REDWOOD CITY -- Kim McGregor appeared to be infatuated with Scott Peterson, and she robbed his home after his wife disappeared.

Monday, Peterson's defense team pointed to the Peterson neighbor as an indication that police ignored other suspects in the missing-person case that turned into a double homicide.

Lead attorney Mark Geragos also suggested that Peterson's former girlfriend, Amber Frey -- after she agreed to secretly record her conversations with Peterson -- did not reveal some of the calls.

The questioning about McGregor and Frey came as Geragos cross-examined Modesto police Detective Al Brocchini for a third day. The defense scored a blow toward the end of last week when Brocchini admitted that he "excised" a key piece of information from a police report.

Sgt. Ed Steele came to Brocchini's defense Friday in an interview with The Associated Press, violating a gag order in the case. This led to a warning -- but no sanctions -- from Superior Court Judge Alfred Delucchi to the Police Department.

Delucchi reminded all of the participants that the order issued by Stanislaus County Judge Al Girolami before the trial began forbids not only the attorneys and police from commenting on the case but also any witnesses who have been subpoenaed, including family members of either Scott or Laci Peterson. The judge said that while he did not want to be a "policeman," he would not hesitate to use his authority to prevent anyone involved in the trial from talking to the media.

I saw Howlin's link and read that abc story. Amazing testimony, and only allowable b/c GERAGOS opened the door to all this hearsay about "tips".

BUT, caution... the ABC story said that Brocchini said in later testimony that he concluded that the guy Scott had that conversation with was probably not credible. The guy called the police with his tip on Dec. 26.

Obviously I know only what we have here about this "guy", but you know what? If it can be shown that the guy DID know Scott well enough to have idle conversations with him, and if he DID know him 9 years ago, when he says this conversation took place, then *I* would be willing to believe that the conversation was as the guy says it was. Hope the jury finds it that way, too.

I once had a friend (extremely mad at her ex-husband, who had done some really bad stuff to her in a divorce) say, "I remember when I found out about (his girlfriend). I was so mad! I should've done him in during my tirade back then--I'd have got off with manslaughter, b/c I really was out of my mind with rage."

She has never, ever done anything physical to hurt her ex, not even close. Her ex is alive and well. It was all idle talk. BUT if her ex had ever turned up dead, well...

Juror No. 5 has now turned up on Nancy Grace's show, whining because he has begun receiving "death threats" in the mail.

Maybe, just MAYBE, if Juror No. 5 had preserved his anonymity (the court would've helped him do that), acted with a little dignity, instead of blatantly and publicly cashing in on his minor role at every opportunity, then MAYBE he wouldn't have to now be quaking over these poison-pen letters!

Don't worry, I emailed the Judge. I said Your Honour, really, when are you going to take control of this case which is now turning into a circus. Why are the Peterson's appearing on 20/20 on Friday night, they are talking outside the court everyday, they have had an article written up on their family in People magazine, - when are their mouths going to shut? They are under the Gag order. This is really UNFAIR to the State. They have adhered strictly to the order while that Hollywood clown has sent out his minions all over the television not to mention Juror #5 who is EVERYWHERE. I told him I don't trust the Jury that is sitting to not view tv or read material and they should be sequestered NOW. Otherwise California is going to produce ANOTHER travesty of Justice!! It was exactly like that but there was actually more.

I love it when that happens.!! This morning when I was getting ready for work there was a Prosecutor or former Prosecutor from somewhere in California who said he felt that Geragos was gonna suffer from his own actions because he has become just too much. Too many theories, too many antics, etc. It is BLATANTLY OBVIOUS that he is disseminating only. He has nothing concrete (pardon the pun)in this case.

Well , if there were other calls they WILL come out. I can see how at first Amber would not want to believe that Scott could really be involved with this. Denial you know.

Denial -- fooey. Am I the only sane woman alive who would be more worried about

1. having slept with a suspected murderer,

2. having exposed my two year old daughter to a suspected murderer, and

3. fearful of becoming suspicious to the police thus risking getting myself considered an accessory after the crime?

No man -- no matter how rich or good-looking or smooth is worth that to me. If the police had a murder investigation going against him my fantasy vision of the man would be set aside at the very least until he was acquitted of murder. And probably not even then.

These lapses in Amber's phone accounts, if genuine, are very disturbing and speak to problems with her in general. Also, they suggest why an otherwise supposedly cooperative and innocent witness needs her own attorney. This last fact is a situation that is pretty much unheard of in murder trials.
