June 28, 2004 -- ALMOST as riveting as an Ann Rule book, tonight's A&E special, "The Trial of Scott Peterson, (A Bill Curtis Special Report)," brings us up to the second on the case that has captured the nation.
How could it not?
On Christmas Eve, 2002, adorable "five-foot nothing," pregnant-as-can-be Laci Peterson took her dog for a walk. Whether she walked into the hands of a brutal stranger or was already dead at the hands of her loving husband, Scott, is the question now facing the six women and six men jurors.
(This number is not counting, of course, the country's newest media star, bounced juror Justin Falconer who was thrown off for violating jury ethics. Why haven't they charged him with contempt, by the way instead of letting him be flown around the country to appear on more talk shows than Bill Clinton?) .........

Peterson prosecution faces uphill climb

REDWOOD CITY, Calif. -- As Scott Peterson's double-murder trial enters its second month, many courtroom observers say the prosecution's case appears to be faltering.
Defense attorney Mark Geragos has used several prosecution witnesses to make his case that the investigation which led to charges Peterson killed his pregnant wife was shoddily executed and designed from the start to implicate Peterson.
Geragos was scheduled to resume his cross examination today of Detective Allen Brocchini, the first investigator assigned to the report that Laci Peterson had vanished. Last week, Geragos got Brocchini to admit to several investigative lapses.

Prosecutors have been thrown off kilter by their own witnesses. A juror who was excused blasted their case.
Sure, it's been a rough week for prosecutors in the Scott Peterson double- murder trial in Redwood City, but that's no reason to panic, say legal experts. It's still early in a case that's expected to last months.
"I'm sure the prosecutor has realized that he hasn't come close to proving his case,'' said former San Francisco prosecutor Bill Fazio. "But he should start getting his act together........

REDWOOD CITY, Calif. June 25, 2004 Police said Friday that Scott Peterson's lawyer tried to give jurors the false impression that authorities investigating the death of his pregnant wife conspired to hide a sympathetic witness.
During his questioning Thursday of Detective Allen Brocchini, defense lawyer Mark Geragos got the man to concede that he failed to record a witness who recalled seeing Laci Peterson at the warehouse where her husband stored his small boat the same boat prosecutors claim Scott Peterson hid from his wife so he could use it later to dispose of her body.
Sgt. Ed Steele, a spokesman for the Modesto police department, said Friday that officials detailed that account in other reports provided to the defense. He said Geragos was trying to mislead the jury..........

Modesto police said Friday that Scott Peterson's lawyer tried to trick the jury into believing authorities conspired to hide a sympathetic witness when, in fact, police detailed the account in reports provided to the defense.
It was a blow in the short-term to the prosecution's double-murder case against Peterson because it looked like a detective intentionally deleted the witness account from his report after realizing it didn't fit with their theory that Peterson killed his pregnant wife.
But it may now work in the prosecution's favor as the trial trudges on into its second month, experts said Friday.

I'm sure that Distaso will be able to FOCUS on this point of attempted trickery by Geragos. If he's smart he will hammer the deceitfulness of Geragos's behaviour until it is drilled into the Jurors heads. Geragos HAD this discovery (interview with the said witness) for at least a year!! I read that the witness thought it might have been Dec. 20th or Dec. 23rd. I'm led to believe that LACI did NOT go into Scott's warehouse because of the chemicals.
I've emailed them all and accused them of attempting to set another wife and baby killer free just to get a headline. The truth just won't suffice for these bottomfeeders.
We've NEVER seen or heard where she is RG. I wondered the same thing myself. I don't even know if she is alive still.

The judge in the Laci Peterson case admonished the Modesto Police Department on Monday for violating a gag order by publicly criticizing the defense.
Under cross-examination Thursday, defense attorney Mark Geragos got Detective Allen Brocchini to admit he deliberately deleted from his report a witness account that could be favorable to Scott Peterson, on trial in the death of his pregnant wife, Laci.
On Friday, Modesto police Sgt. Ed Steele told The Associated Press that Brocchini omitted the material because it is in other police reports provided to the defense.
"It's Geragos' spin," Steel told the AP.
All parties in the case are bound by the order that prevents them from talking.
Judge Alfred A. Delucchi called a Modesto police captain from the gallery Monday to stand before him.
"This has to stop," Delucchi said. "Go tell the chief that he's going to have to sit on his folks ... or there's going to be trouble."

Not yet Jackie. I am home today so I will keep checking. They mentioned one little blurb when I turned CTV on but it was just that Beth Karas would be giving a report at 12:30 I think. I'm hoping that Distaso is snorting mad today. I would like to see him exert some aggressiveness like he did that one time in the Prelim!! He CAN do it. Let's hope that Geragos pushed his buttons on Friday.

Amber may have taped Peterson before she went to the Police. She became aware of Peterson's marriage on Dec. 9th. On December 10th he goes and buys a boat. On December 14th, Peterson takes Amber to her Christmas party while leaving Laci alone at a couples baby shower. It was during Peterson's little explation to Amber about being married that he said he had "lost" his wife a year ago and that this would be his FIRST Christmas without her.
I'm not sure if Amber's friend told her about Laci "missing". I do know that SP begged Amber's friend to let him tell Amber himself about being married. That way he could lie and say that he WAS married but had lost his wife. Plus shed a few crocodile tears. HOW Amber found out about Laci JUST going missing I don't know but it was less than week before she went to Police herself.
I just listened to Beth Karas and she says there is "friendly cross-examination" of Brocchini going on still. They are dwelling right now on Kim McGregor. It appears to me that Geragos is just throwing anything and everything out there. Obviously Distaso has NOT be able to do his re-direct yet. According to Kimberly G-Newsome there is just a bunch of what if's coming out attempting to establish reasonable doubt.
I read that Article bear. I do agree that Amber probably didn't want to believe that Scott was responsible. But her attorney says, it will be Scott's OWN words that harm him a lot more than Amber's.
It's true! The guy has another woman expecting his child and he already has one with that same woman.
Such class, eh? She really can pick 'em.
