When a group of children reported hearing screams and seeing a woman's body in a creek not far from the former home of Scott and Laci Peterson, police in Modesto geared up for the worst Tuesday night.
A short time later, authorities, using a helicopter and searchers on the ground, found what had prompted the scare -- a large beaver.
The false alarm came in around 8:30 p.m. with disturbing details. The children, at least one of whom was 11 years old, said a dark-haired woman's body, clothed in a ripped white shirt, was floating in Modesto's Dry Creek........

REDWOOD CITY - A string of prosecution witnesses testified Monday that Laci Peterson frequently complained of fatigue and had pledged to give up exercise walks in the weeks before her disappearance. Scott Peterson claims his wife planned to walk the couple's dog the morning he left for a solo fishing trip and returned to an empty home.........

Juror dismissed from panel
By Jason Dearen
Snip it:
"Breaks in the case
The major break for detectives came in late December, when Amber Frey called the Modesto Police Department's tip line. "I was standing behind the clerk's desk; she was typing in a claim from someone claiming to be his girlfriend," Brocchini said.
Brocchini and another detective drove to Frey's house to check her story. Moments later they were at a Radio Shack, purchasing a recording device for her cell phone.
"I told her not to tell (Peterson) you are working with the police. Just let him keep talking to you ..." Brocchini said. Distaso asked how long it took for Frey to record a call.
"She recorded a conversation while we were there," he said.
The other break came while studying a photograph of Scott Peterson's boat two months after it was taken. For the firs time, Brocchini noticed a pair of pliers with a hair attached resting on the boat's bottom. The hair discovery "was kind of an exciting moment for us," said Brocchini. That hair has not been identified as Laci's, but has been excluded by DNA testing from belonging to Peterson.
At one point in the video, Brocchini tried to confuse Peterson but had the tactic backfire. Peterson said he made two calls to Laci from the marina that day, one at 2:17 p.m. and another on his way home around 4:30 p.m. "I have a couple of concerns. One is from the cell phone call at 12:17, you said 2:17 but the time stamp (on Peterson's cell phone) says 12:17," Brocchini says in an accusatory tone.
Peterson grabs the cell phone and checks the time stamp. After checking he tells Brocchini he mixed up the times. "You said it," Peterson said. With a slight pause to look at his notes, Brocchini admits, "Yeah, you're right."".....

Juror No. 5 removed, motion for mistrial denied
Justin Falconer, previously known to the world as Juror No. 5 in the Scott Peterson murder trial, speaks with the media after he was kicked off the jury Wednesday.
JOHN GREEN/THE ASSOCIATED PRESS
Snip it:
"Falconer said he would not vote to convict Peterson of murdering his wife, Laci, an unborn son, Conner, from the testimony so far presented. Speaking to a media throng outside the courthouse, he declined to comment on whether other jurors felt similarly. "

Three egg facial. LOL
I agree, "the defense attorney" won't produce this witness and he won't produce Winona's receipts.
LOL..probably the same new FReeper I exchanged freepmail with. We agreed to disagree, I welcomed him/her.
Distaso has it covered, not to worry. :-)
I'm gathering here that the witnessing of Laci at the warehouse happened the same time that she was getting her facial waxing. Who're we to believe? Geragos, or their own lying eyes (and cameras, and receipts!) lol
Geragos is going to pull a lot of this. Take a close look to see where the smoke and mirrors are hidden in every instance.
I made the decision that Scott was guilty when I saw his interviews. His own words and behavior convicted him for me. I can't believe that he was saying that stuff as an innocent man and the police just have us all baboozled.

HALF SISTER CRIPPLES SCOTT'S DEFENSE
BY DON GENTILE AND DAVID WRIGHT
SYNOPSIS
In a shocking development, Scott Peterson's half-sister has given damaging information to investigators - evidence that could destroy his defense, the NE has learned exclusively.
The new revelations-coming directly from a family member-will have a powerful influence on jurors in his murder trial.
Scott's half-sister Anne Bird is directly contradicting her brother's major-assertion-that his pregnant wife Laci was kidnapped while walking their dog, as she did every day.
But just a few weeks before she vanished, Laci was tiring so easily that Scott had to push her around in a wheelchair!
Anne made that bombshell revelation to Modesto, police. Interviewed by Det. Grogan, Anne revealed she'd gone to San Diego, where Scott's parents live, in late November 2002, to attend a baby shower for Laci.
In the days before the shower, Anne joined Scott and Laci for a trip to Disneyland. While visiting the amusement park, Scott "rented a wheelchair to push her around in," Anne told Det. Grogan, according to police files obtained exclusively by the NE.
During his opening statement at Scott's trial, prosecutor Rick Distaso was able to introduce that key information. "Scott and Laci go to Disney's California Adventure," Distaso told the jury. "While she is there, Laci gets tired-she's tired, she doesn't want to walk anymore, and the defendant actually gets a wheelchair for her and pushes her around, because she is not walking so well."
Laci told her mom Sharon, that she had gotten sick and almost passed out walking in the park near her home. Laci told her doctor about the problem after she had a dizzy spell while walking for 20 minutes.
"Scott had to know that Laci was suffering from dizzy spells and that her doctor recommended she not walk anymore." Yet he still maintains that Laci was walking the dog the day she disappeared.
When Anne asked Scott what he thought had happened to Laci, he didn't mention a brown van that his attorney claims was involved in the abduction. Instead, Scott offered yet another story.
"He told her he thought Laci was taken by an individual possibly related to a purple car with Confederate flags in the back, that had been parked at the park near Scott and Laci's home," Det. Grogan wrote in his report.
Ironically, Scott's half-sister lives in Berkley-not far from the marina where he said he was fishing on DEC.24, 2002. Anne likes Scott but told the truth when interviewed by investigators.
"Anne is going to be a witness for the defense," disclosed a source close to the case. "The'll be calling her in an attempt to have her balance what she told police about Scott - with testimony that paints him in a more favorable light."
In her interview with Grogan, Anne also revealed that Scott visited her several times between the time Laci disappeared and his arrest-and that he admitted one of his affairs.
Scott told Anne it occurred while he and Laci were in college and that Laci was aware of it because the woman, Janet Ilse, had walked in on him and Laci while they were in bed together.

THE NE REPORTER'S NOTEBOOK!
Murder Trial Week #3
Scott Peterson is definitley guilty in the opinion of most of the trial groupies who compete for ringside seats at his murder trial.
They have come from as far away as Vermont and Ohio. One collects autographs from reporters, while another is a lawyer at a practice called "The Strange Law Firm."
They vie each day for coveted "public seats" available in the courtroom.
Most are convinced Scott killed his wife, according to engineer Phil DeVan of Burlington, VT., an admitted trial junkie, who rented a local residence just to attend the proceedings. "I like trials," he told NE, spouting off a list of other court battles he's attended around the country.
Each day, DeVan joins as many as 70 court watchers who gather at 7:30 am. at the back entrance to the courthouse to participate in a lottery for one of the 30 public seats.
L******S****, a pretty single mom, came from Cleveland and stayed with a friend to attend the. In her opinion, Scott believed he could get away with murder because "he thinks he's smarter than anybody else."
L***** gives trial updates on www mistfiting dot com, a personal Web site she's titled "Observations of a Mistfit."
Not everybody thinks Scott's guilty. One of his strongest supporters, Marlene Newell, is a regualr at the trial. She runs a website called scott'sinnocent dot com "I don't think there is enough evidence to even warrant an arrest," she told NE.

L*** real name is in the NE, but the pope is not comfortable posting it!
OK TO COPY TO OTHER FORUMS!!
L***** is Loretta from misfitting.com
Distaso has it covered, not to worry. :-)

Thanks pinz- I needed to hear that...
Yeah but with the juror who was released saying the prosecution isn't proving the case I got a feeling where it's all going to end up... with Peterson walking. Not much justice for his wife if he's the one who did it.
Watched Greta concerning this & the only one that didn't think it was serious was Feiger! I think MG is going to try to use the "mark furhman" approach to this case, make Brochinni look bad, so nothing the pros. puts out will believed.
HEE HEE, we've noticed, but for the sake of your blood pressure, try to ignore, it's not worth it.
Yeah, me too, only Feiger had anything positive to say!
Oh yeah, BIG TIME! I think this case WAS winnable, but with the prosecution having witnesses that are breaking his back, what can he do? Most the "experts" (HAH) on the talk shows think it's OVER.
>>"Anne is going to be a witness for the defense," disclosed a source close to the case. "The'll be calling her in an attempt to have her balance what she told police about Scott - with testimony that paints him in a more favorable light." <<
It sounds good at the beginning of the article, until you get to this........
Lookie here:
But in a taped interview with Brocchini on June 23, 2003, a woman who rents part of the warehouse where Scott Peterson also has space told the detective that Laci had come in the warehouse December 23, 2002, and asked to use the bathroom in the woman's section of the building.
Now why would she need to use the bathroom in another unit????
Bogus.
I read that Jackie. WHERE did Peterson EVER think to call 911???
That's what I'm thinking. As this trial progresses Geragos is seemingly painting himself into and smaller and smaller corner.
Hey, you know the theory that he put her in the boat during the night and went out to Brooks Island?
Here's a picture of an old pier on Brooks Island -- he could have pulled up under there and put those anchors on her!
http://www.kayaker.net/images/b/broksi81.jpg
Right on. You know I have been experienncing the odd pang of fear but overall I am still CONFIDENT that Distaso KNOWS what he is doing. He has been working diligently and thoroughly for over a year. He's smart, he's disciplined, and he KNOWS this case - every single detail of it. As to rebutting some of these seemingly bad things that come up, I think he will. He'll rebut ALL this "stuff" right before the Jury has to go to deliberate. He'll make sure that the corrections are FRESH in their minds plus he will have pulled all of these bits adn pieces together to make a complete picture!! I think we should be ENCOURAGING the Prosecution. Whether it be in emails or in letters to the Editor!! We also need to keep pointing out that Geragos is a self serving GRANDIOSE buffoon who has NEVER produced his unbeatable EXCULPATORY evidence in a number of his cases.
SCREW GRETA!! She makes me ill!!
