From what I understand, because the current limits on "Indian gaming" in California are pursuant to a ballot proposition, Arnold doesn't have the Constitutional power to enact this "deal." Either a law has to be passed by the legislature or by initiative statute, and perhaps only the latter.
I have always been dubious in general about the way this kind of dealing skirts restrictions in the US Constitution that only the federal government conclude treaties with foreign nations. Either the tribes are US citizens or they are not.

Coercing the casinos to pay more taxes wont help solve the crisis in California. The legislature will have spent the extra money three times over before the Indians have even cut a cheque.
PS: Am I the only one who finds Arnolds use of the words fair share to describe what the Indians need to pay as worrying?

I read in the San Francisco Chronicle that AS may have been stabbed in the back by the tribes, who will use a gray area in the law. Apparently, if the slots are run by a central computer in the casino, they are considered "video lottery terminals" and not subject to paying money to the state. These terminals look like and function like regular slot machines and differences would not be noticed by most players.
Personally, I hope Prop 68 DOES pass. It would make more sense to know that the state will get 30% from the tracks and card clubs, not to mention the percentages to the county and city governments. Slots would also increase the handle for racing and benefit the government and the horsemen.
