"Italian law authorizes the government to carry out mass texting "in cases of disaster or natural calamities" and "for reasons of public order or public health and hygiene".
Can one interpret EU as a disaster and natural calamity? Well, not quite natural - man-made, rather, but still as a calamity? If yes, then clearly the government's action was within the statute, both in the letter and in the spirit.
