Sister gave birth to baby, who died
PORT ARTHUR -- A 19-year-old man will be tried in September on a charge of prohibited sexual conduct with his younger sister, who gave birth to a baby found dead in a high school band bag.
The girl, who was 15 when she gave birth, has been charged in juvenile court with capital murder. An adult certification hearing for her is set for June 10.
The maximum sentence that can be considered in juvenile court on a capital murder charge is 40 years, prosecutor Randi King said. In the adult system, she could get life in prison.
Prosecutors allege the siblings had an ongoing sexual relationship that resulted in the birth in November.
The brother, who is free on bond and set for trial Sept. 1, graduated from Port Neches-Groves High School last week, the Port Arthur News reported Wednesday. If convicted of the third-degree felony, he could face from two to 10 years in prison and up to a $10,000 fine.
Attorney David Barlow, who is representing the brother, declined to respond to the allegations Wednesday.
"This is one of those cases where nobody wins no matter what happens," he told The Associated Press.
The brother said in a sworn affidavit that he had intercourse with his sister on more than one occasion at their home in Port Neches, according to the paper.
The newborn boy was discovered hidden in the girl's bedroom last fall after she was taken to the hospital because of excessive bleeding, Jefferson County District Attorney's office investigator Steve Thrower said in an affidavit. He said there was no evidence the boy forced his sister to have sex.

They should move to Massachusetts and demand to get married.
That is something you hope you never have to worry about.
What good would it do to punish either. They have already suffered enough. We should ensure that they get a good education and become responsible parents for the future.

You are absolutely right. It is a failure of edeucation. These siblings were never taught the joys of masterbation and they were never the beneficiaries of distributed condoms.
This is Bush's fault, you know how he is with all that "compassion" and religiosity and no federal money for sex toys.
I don't think I can agree on this one. They may have suffered but they have not been punished for letting that child die. These kids should have known right from wrong and they chose to make very poor choices multiple times.

My daughters are 16 and 18 and I would hope that I would notice at least some of the other pregnancy changes, even some of the behavioral ones.
I see your daughter is just a little bitty girl, but as a doting daddy, you would probably notice those other changes in your daughter, also.
But of course, I know that requires parents that actually pay close attention to their kids and these parents may not be that way.
I'm sure we'll soon be seeing their faces on the NEW state of california seal.
